【摘要】 内蒙古自治区是一片美丽的沃土，内蒙古自治区更是一片神奇的沃土。改革开放30余年来，内蒙古自治区依托资源优势实现了跨越式的发展，特别是西部大开发战略实施以来自治区的GDP增长速度更是曾连续8年位居全国第一位，创造了“内蒙古奇迹”。但社会经济高速发展的代价同样不菲，其对环境的破坏尤为触目惊心。矿产资源开采规模的不适当扩张、污染物的非法排放带来的巨大环境压力，让环境承载量原本不高的内蒙古自治区更加难堪重负。虽然自治区政府确立了以“把生态建设作为重要的基础建设来抓”的发展战略，但是内蒙古自治区的生态补偿主要以政策的形式出现，而且缺少自治区地方性色彩，生态补偿的内容界定不明且生态补偿组织管理混乱，缺乏有效的监督。这些原因导致自治区生态补偿在实践中可操作性差，对生态环境的恢复以及保护产生巨大阻碍。因此，应该建立一整套规范和完善的专门针对内蒙古自治区生态补偿的法律制度，以法律的手段来界定自治区生态补偿的主要内容，规定自治区生态补偿组织管理体系，进一步建设生态内蒙古，完成“五位一体”总布局。本文从内蒙古自治区实际情况出发，并对国内现有的生态补偿法律制度进行分析，结合对国外典型国家的生态补偿立法和实践的考察和借鉴，为建立和完善内蒙古自治区生态补偿法律制度提出初步的建议。更多还原

【Abstract】 Inner Mongolia Autonomous Region is a beautiful fertile soil, even is it a magical fertilesoil. Since the thirty years from reform and opening, the Inner Mongolia Autonomous Regionhas taken the advantages of local resources to achieve the great-leap-forward development,especially after the implementation of the strategy of Western Development, its GDP growtheven ranked at the first over the eight years in succession, creating a Inner Mongolia miracle.However, it comes at a cost with rapid development of the socio-economic and the damagesto the environment are even shocking. Inappropriate expansion of mineral resourcesexploration and the illegal discharge of pollutants both increased the pressures on InnerMongolia’s environment which the original environmental bearing capabilities are not thatstrong. Although the regional government established a task as essential infrastructure for the"ecological construction" development strategy, Inner Mongolia Autonomous Region’secological compensation appears in the form of a policy and lacks the local features of theautonomous region, meanwhile, the contents of the ecological compensation is ill-defined,related management is under chaos and lack of effective supervision. These reasons lead tothe difficulty for the eco-compensation. It hinders the recovery and protection of ecologyenvironment. So we should establish a complete regulation and improve the legal system ofeco-compensation. And we should define the main contents of eco-compensation in terms oflaw, and establish the eco-compensation system in order to achieve "five in one" pattern. Thepaper analyzes the current legal system of eco-compensation according to the real situation ofInner Mongolia. In the mean time, it combines with the foreign cases of eco-compensationwhich provides some initial advice for the legal system of eco-compensation in InnerMongolia Autonomous Region.更多还原
