【摘要】 在我国社会主义市场经济体制的建立过程中，社会上充斥着各种各样的假冒伪劣产品，假冒伪劣产品所导致的产品质量安全事件频发已经成为制约我国经济可持续发展和构建和谐社会的瓶颈。正如德国社会学家贝克在《风险社会》中所揭示的：人类社会在后“工业化”时代已步入“风险社会”。质量技术监督（简称质监）部门担负着生产领域产品质量安全监管的职责。通过多种监管手段和措施的实施，监督企业生产出合格的产品。但是由于政府监管部门监管不利导致的产品质量问题一直在威胁着人民群众的身心健康和生命财产的安全，甚至演变成产品质量安全事件。本文以公共管理学、公共经济学等理论为指导，从国内外产品质量监管的现状入手，通过对现阶段黑龙江省质监部门职能、监管流程和监管措施介绍，以国内外有关监管的理论及相关研究成果为基础，分析了黑龙江省质量技术监督部门产品质量监管的现状，阐述了在监管过程中存在的问题，地方保护主义的存在，监管部门的利益冲突，监管人员被俘获，法律的不完备，标准的滞后。在分析国外和其它省市的可借鉴的相关经验的基础上，提出了黑龙江省质监部门加强产品质量监管的问题对策：基于合谋的理论，提出了通过激励和防止合谋契约来破除地方保护主义；基于部门利益主义的理论，提出了整合监管部门，提高行政资源的有效配置；基于街头官僚和合谋的理论，提出了防止监管人员不作为的方法；基于不完备法律理论，提出了修改法律和建立健全标准。更多还原

【Abstract】 During the establishment of China socialist market economy system, frequentquality incidents caused by fake products have become bottlenecks that constrainsustainable development and construction of a harmonious society, just as whatGerman sociologist Beck disclosed in Risky Society that human society hadentered into risky society from industrialized society.Quality and technique supervision departments take the responsibility ofsafety supervision of products in production procedures by using multiplesupervision measures, aiming at that enterprises produce qualified products.However, fake products have been always threatening the safety of people’sphysical health and safety of life and property, even in extreme cases safetyaccidents and events being caused.Guided with public management and public economics theories and referredto domestic relevant research results, the author of this article researched thecurrent product quality safety supervision condition of Heilongjiang Quality andTechnique Supervision Department, and described the existing problems insupervision activities, such as local protectionism, interest conflicts amongsupervision departments, supervisors being corrupted, imperfect laws andstandards. After analysis of the experience of other province and overseas, theauthor comes up with some solution. Based on collusion theory, collusion-proofcontract was put forward to break local protectionism; based on sectional interesttheory, integration of supervision departments was put forward to improveefficient allocation of administrative resources; based on street-levelbureaucratic and collusion theory, some methods was put forward to avoid acts ofomission; based on imperfect law theory, amending laws and establishing perfectstandards were proposed.更多还原
