【摘要】 荀子在适合当时的社会环境下提出了“隆礼重法”思想,开创了礼法相结合的先河,认为礼法的结合十分重要,同时也是十分必要的,这对于中国的封建法律制度,提供了统治思想以及理论基础,并对中国几千年的传统的法律文化之发展产生了重要的影响。并且在当今的社会主义法治建设阶段,荀子的“隆礼重法”思想也有着及其重要的现代价值,值得思考。文章深刻探索荀子“隆礼重法”思想产生的历史原因及理论基础,并对其礼治,法治的起源、含义、内容,运用,以及“礼法”关系进行了深度剖析,为正确与全面的研究荀子礼法观对中国当代的法治建设有着深远的现代价值。依据当今中国社会主义法治建设的现状与所处的时代环境,分析中国传统法律文化中荀子“隆礼重法”思想的时代意义,以及“隆礼重法”思想中的精华对中国法治建设的价值。论文除引言之外,共有三章内容。第一章阐述了荀子“隆礼重法”思想的形成过程,包括其思想产生的历史根源：时代背景以及文化背景；并同时重点阐明荀子“隆礼重法”思想形成的人性论基础,介绍了人性恶的基本原理,更深刻的认识荀子性论的意义以及对当代人品格塑造的重要性。第二章着重分析“隆礼重法”思想,阐述了礼的起源、内容、实施方法,通过对礼深入的阐述,为后面讲礼对当代中国法治建设的影响奠定了理论基础；荀子之法与孔子之法,法家之法的比较中阐述荀子法的内涵,并进一步说明法的内容以及法的司法运行,对当今法治有很大的影响作用；引申出人们对礼的自觉遵守和对法的不得不遵守的思考,从而更深刻的认识礼法相辅相成的作用。第三章重点论述了荀子“隆礼重法”思想对中国法治建设影响,主要是从对当今中国法治理念的形成、中国立法、执法、司法、守法建设产生了深远的影响等方面加以阐述。把荀子理论与当今法治建设的现状联系起来审视,意义深远。对于荀子的思想我们应当辨辩证的分析,取其精华,除其糟粕,将其合理的思想适用于当今的法治建设,将推进中国社会主义现代化法治建设进程。研究荀子“隆礼重法”思想与当今中国法治建设,目的在于通过梳理荀子礼法思想及其礼法关系,揭示其对中国法治建设的深远影响,我们在借鉴古代荀子礼法思想过程中吸取其精华,会对中国法治的长远建设产生更为深远的影响。更多还原

Even the socialistic modernization today, in building a socialist harmonious society, building a socialist country ruled by law in the new period, the thought of blazing light still shines, having important sense, be worth to think deep."Grand ceremony law" thought and the rule of law with the rule of rites, seemingly contradictory to the country and thought of harmonious and unified rise, dialectical analysis of two philosophical consistency, Xunzi transformed the "ritual", gives the "law" of the spirit, the implementation of "ceremony" as the purpose of study, put forward a by combining management and the rule of law state route.This article deeply explores Xunzi "prosperous ritual law" thought of the historical reasons and theoretical basis, and the rule of law culture, origin, meaning, content, application, and "etiquette" relation undertook deep analysis, for the correct and comprehensive study of Xunzi law concept to Chinese influence the rule of law foundation.
