【摘要】 摘要：埋藏物之发现是动产所有权原始取得的方式之一,其法律效果在于确认埋藏物所有权的归属。虽然埋藏物在日常生活中不占重要地位,但埋藏物的发现却引起了许多纠纷和诉讼。而我国现行法律对埋藏物的法律内涵、发现行为的构成要件、发现人的奖励标准等问题都未作出明确规定。我国在立法上一贯采取国家所有权主义的立法模式,过高地估计了人们行为的自觉性,夸大了现实条件下人们思想意识的觉悟程度,并由此对人们的行为提出一些苛刻的法律要求,导致人们上交埋藏物的积极性大大降低。埋藏物发现制度的不完善,也导致在具体实践中不能均衡相关方的利益诉求。因此,本文主要是通过对埋藏物发现案例的介绍,归纳、分析案例中涉及到的争议焦点问题,并进行了相关的法理分析。通过论述,使与埋藏物发现制度有关的基本理论问题得以澄清。在此基础上,研究得出案例结论。论文的重点部分,主要是通过案例的分析及研究,指出现行埋藏物发现制度存在的问题,并进行了相关的思考与探索,提出了一些完善措施与改革建议。更多还原

【Abstract】 Abstract:Treasure troves discovered was one of the original made of movable property ownership, its legal effect is to confirm a treasure trove of ownership attribution. Although the objects buried in everyday life does not occupy an important position, but the treasure trove of discovery has caused many disputes and litigation. The treasure trove of China’s existing laws on legal connotation, found the behavior of the constituent elements and found that the human issues such as award criteria neither clearly stated. China in the legislation on state ownership doctrine has always taken the legislative model overestimated the consciousness of people’s behavior, under realistic conditions exaggerated level of political consciousness of people’s ideological consciousness, and thus on people’s behavior to make some stringent legal requirements, resulting in it turned over a treasure trove of enthusiasm greatly reduced. Treasure trove of discovery system is imperfect, but also result in concrete practice can not balance the demands of stakeholders. Therefore, this is a treasure trove of discovery through case presentation, summarize, analyze cases related to the focus of controversy, and carried out the relevant legal analysis. Through discussion, the treasure trove found in the system with the basic theoretical issues related to clarification. On this basis, study case conclusion. Thesis highlights, mainly through case analysis and research, pointing out that problems in the existing system of treasure troves discovered, and making the relevant considerations and to explore and put forward a number of improvement measures and proposals for reform.更多还原
