【摘要】 本文从我国小商贩的现状出发,分析我国小商贩的产生源自社会保障体系的不健全、市场经济需求催生、成本收益考较等因素,指出现行制度下小商贩的违法现状及与城市管理者之间剧烈冲突的治理困境,并提出小商贩合法化面临法律制度供给缺位及越位的制度障碍,小商贩制度是对公民生存权及就业权的保障,小商贩的发展彰显了市民社会平等、自由的核心价值,同时也是对中国市场经济的重要支持。对小商贩进行合法化有直接规定为无名商主体的实践尝试,但较为适宜的是纳入现行个体工商户制度中并对个体工商户制度进行一定的改革,当然,鼓励小商贩合法化并不意味着对其自由经营的全部承认,应当权衡小商贩的私权与社会公共利益的均衡,实现小商贩经营权利与社会公共秩序的维护。更多还原

【Abstract】 This article departure from the present situation of China’s small traders, analysis of the apperance of small traders generated from the social security system is not perfect, the demand for the market economy, the cost-benefit considerations and other factors,and there is a big conflict between small traders and city managers. and pointed out that the legalization of small traders in view of the small traders system, the development of small traders highlight public social equality,the core values of freedom, but also the important support of China’s market economy.Legalization of small traders direct provision for the main body of the practice of unnamed business subject try, but it is more appropriate, incorporated into the existing system of individual businesses and individual industrial and commercial households system reform, of course, encourage the legalization of small traders do not means all admit it to operate freely,it should weigh the balancing of private rights and public interests of small traders, and the small traders operating rights and the maintenance of social and public order.更多还原
