【摘要】 近年来，我国检察机关积极参与“行政执法与刑事司法的衔接工作”，依托检察权不断深入开展对行政执法机关移送涉嫌犯罪案件的监督，既推动了行政执法机关依法行政，同时加大了对经济、民生、环境等多个社会生活领域刑事犯罪的打击力度，更好地发挥了检察机关维护稳定、推动法治的积极作用。本文从基层实务工作者的视角，对检察机关的监督移送工作进行了理论分析和实践探讨，以期深化检察职能，深入推动机制建设和司法实践。论文共分五章，第一章为对行政执法机关移送涉嫌犯罪案件的检察监督的概述。介绍相关概念的定义、内涵及外沿，论述理论基础。第二章阐述对检察机关开展对行政执法机关移送涉嫌犯罪案件监督发展过程及意义，介绍目前的实践现状。第三章是对现状、问题和原因的分析。指出目前实践中的问题并分析产生的原因。第四章是对部分国家行政执法及其监督的比较分析，分析其他一些国家行政执法、行政处罚制度设计和监督机制。第五章是对行政执法机关移送涉嫌犯罪案件检察监督的实践探索和框架设计，从一个市级检察院多年来的实践经验出发，提出改进和完善的建议和方案。更多还原

【Abstract】 In recent years, the Chinese prosecutorial organs participate in the link-up betweenadministrative enforcement of law and criminal justice actively, deepening the exercise ofsupervision on administrative law-enforcement organs’ transferring the case of criminaloffense under the procuratorial power. By this way, not only does it promote legaladministration, but also increases the attack on criminal offence in different social fields,such as economy, livelihood and environment, etc. As a consequence, prosecutorial organsplay a more positive role in maintaining social stability and promoting the rule of law.This thesis attempts to devote theoretical and practical analysis on the operation ofprosecutorial organs’ supervision and transferring work from the perspectives ofgrassroots and actual situation workers. Therefore, it has access to make contribution todeepen procuratorial functions, enhance institutional building and promote judicatorypractice. The thesis is divided into five chapters: Chapter One briefly expounds thetheoretical basis containing related definition, connotation and extension, focusing on theexercise of supervision on administrative law-enforcement organs’ transferring the case ofcriminal offense. Chapter Two concentrates on its significance, development history andpresent situation. Chapter Three analyses its present situation and reasons according to theproblems. Chapter Four makes comparative analysis on administrative enforcement of lawand supervision in some countries, especially the executive law enforcement,administrative punishment system design and supervisory mechanism. Chapter Fiveattempts to conduct practical exploration and framework design based on the practice of aMunicipal People’s Procuratorate.
