【摘要】 在我国，司法就是人民法院行使审判权的过程，具体说来就是人民法院依照法定的职权和程序，被动适用法律于具体案件的专门活动，任何组织和个人都必须执行，不得擅自修改和违抗。而司法公信力则是人民法院依照法定的职权和程序，被动适用法律于具体案件，并使公众在心理上对其认同和受其约束。司法公信力的结构要素就是司法公信力必须具有的实质、本质以及构成部分。具体包括四个要素，分别是权威、公正、公开、效率。改革开放以来，人民对司法的认同性越来越高，但是不可否认的是目前司法过程中也存在一些问题，直接导致司法公信力存在缺失。当前我国存在司法公信力程度较低，社会公众对司法的预期与实际效果存在重大差距，司法公信力的提高阻力重重等现状。具体导致司法公信力缺失的原因则是由于历史性原因，体制性原因，司法机关内部原因，文化性原因等多种原因复合而造成的。针对以上问题，如何通过有效的措施重塑司法公信力将是本文研究的重点。司法公信力本质属于意识的范畴，根据马克思主义哲学物质决定意识的理论，构建司法公信力的根本在于发展社会主义生产力。但是也不能否认的是事物之间是普遍联系的，司法公信力的构建是一个系统的工程，应从影响司法公信力的各个方面入手，全面的解决司法公信力程度较低的问题。综合各个方面的因素，重塑司法公信力需从司法内部即司法体制改革、加强法官制度建设以及引导正确的司法理念三个方面进行。更多还原

【Abstract】 Specialized activities in our judicial process is the people’s court to exercisejudicial power, specifically the People’s Court in accordance with the statutoryauthority and procedures, passive applicable law in a specific case, any organizationor individual must perform, are not allowed to modify and defy.The judicialcredibility of the People’s Court in accordance with the statutory authority andprocedures, passive applicable law in specific cases, the public and its identity andsubject to its constraints psychological。Structural elements of judicial credibility isthe credibility of justice must have the essence of nature, as well as components，including the four elements are the authority, impartiality, openness, and efficiency.Judicial recognition of the people have become more sophisticated, but it isundeniable that there are some problems in the judicial process, a direct result of thedeficiencies in judicial credibility. Of lower degree of judicial credibility; public thereis a significant gap between the expected and actual effects of the administration ofjustice; improvement of judicial credibility obstacles status quo.The specific reasonsfor judicial credibility does is caused due to the variety of historical reasons,institutional reasons, the judiciary internal reasons, cultural reasons composite.To solve the above problem, how effective measures remodeling the judicialcredibility will be the focus of this study.The judicial credibility of awareness of thenature of the category, according to the material determines consciousness theory ofMarxist philosophy, build the judicial credibility lies in the development of thesocialist productive forces.But can not deny things is generally linked to the judicialcredibility of the building is a systematic project, should affect the various aspects ofthe judicial credibility, lower a comprehensive solution judicial credibilityproblem.Factors integrated in all aspects, to reshape the credibility of justice from thejudicial internal reform of the judicial system, strengthening the building of the judgesystem and boot correct judicial philosophy three aspects.更多还原
