【摘要】 劳动保障监察作为维护劳动者合法权益的主力军,是和谐劳动关系创建的主要责任体。面对劳动用工形式日趋多样性和复杂化,劳资矛盾日益突出和尖锐,严峻的形势考验着劳动保障监察机构的执法能力和水平,如何能提升劳动保障监察的行政执法效能,成为摆在我们面前的一个重要课题。本文首先结合行政体制和劳动保障监察行政组织的现状,讲述我国几十年来劳动保障监察的发展历程,分析了现存的问题。结合美国、加拿大、韩国、日本四个国家的劳动保障监察体系和制度,从中借鉴相关的先进经验,希望能为我所用,对我国今后劳动保障监察的行政效能提升能产生积极意义,同时将新公共管理理论和行政效能理论引入到组织机构的调整和日常工作管理中,强调劳动保障监察执法职能的充分履行,希望其中的绩效考核理论、服务理论、行政单位企业化管理理论可以对于提升劳动保障监察执法效能有所帮助。通过上面的分析,作者建议通过提升人员素质,调整人员结构；加强学习培训,重新架构行政组织结构,科学制订考核指标,加强信息化建设,强化制度创新和监管六个方面作为提升劳动保障监察行政效能的方法和渠道。希望能为我国劳动保障监察理论体系的完善做出自己的一点贡献。更多还原

【Abstract】 As the main force of the maintenance workers’legitimate rights and interests, Labor security supervision is the main responsibility to build harmonious labor relations. We are faced with acute situation that Labor forms are diversified and complicated, and labour conflicts become more and more outstanding, which tests the law enforcement capacity and level of labor security supervision organizations, and also we are faced with an important issue how we can improve the effectiveness of administrative law enforcement of labor security supervision.First of all, this article combining the current situation of administrative system with the administration of labor security supervision organizations, tells the developmental process of labor security supervision for decades, and analyses existing problems. We can learn lessons from labor guarantees monitored system and rules of the United States, Canada, Korea, and Japan, which have important effect on improving our nation’s legitimate enforcement of labour security supervision. At the same time, we can bring the theory of public management and the theory of administrative enforcement into the adjustment of organization and management of daily job, stress making full use of labor monitored law enforcement functions, and hope that performance examination theory, service theory, and administrative unit business management theory can help promote labor security supervision of law enforcement effectiveness.Through the above analysis, the author recommends raising the quality of personnel, adjusting the personnel structure, strengthening training, re-structuring administrative structure, formulating scientific evaluation indicators, strengthening information construction, and strengthening the system innovation and regulation to promote labor security supervision of administrative efficiency. The author hopes make contributions to complete China’s labor security supervision system.更多还原
