论我国假释制度的完善

【摘要】 假释制度于20世纪初引入我国，而在司法实践中广泛应用，则在新中国1997年新刑法颁布以后。纵观近二十余年，我国获得假释的罪犯人数占在押罪犯总数始终在2%左右，如此低的假释率使得假释这个高效的刑罚执行制度没有完全发挥出其应有的功能，造成了监狱监管压力增大，国家行刑资源的浪费和对监管场所的财政支出不能有效减少，罪犯这个特殊群体的劳动力资源无法为社会所用，罪犯释放后适应社会困难等诸多社会问题。鉴于此，笔者将对典型案例和调研数据进行深入分析，找出我国假释制度在行刑理念、具体内容、实践运行等方面存在的共性问题，并客观分析问题的成因，有针对性的提出完善假释制度的具体举措。本文分为三个部分，第一部分通过典型案例和典型数据分析，找出了我国假释制度存在的八个问题。第二部分是对我国假释制度出现问题的成因分析。主要是从刑罚报应刑观、重刑观在我国执法者及公众内心的根深蒂固、社会公众对假释制度的模糊认识和对假释罪犯再犯罪的低容忍度、假释制度在我国创立和运行时间较短，经验不足、我国立法者、执法者对假释制度不够重视、对于罪犯“没有再犯罪危险性”评定存在理论上和实践上的难度五个方面进行深入分析。第三部分是对完善我国假释制度的具体举措，主要从以全新的刑罚执行理念来指导假释制度的改革、科学确定“罪犯再犯罪危险性”评定包含的具体标准，打通假释制度适用的关键症结、对于我国假释权重新配置、对罪犯假释实质性条件进行修正四个方面提出个人见解。更多还原

【Abstract】 The parole system was introduced to China in the early20th century, in judicialpractice widely used in the new China in1997after the promulgation of the Penal Code.Throughout the past twenty years, the total number of prisoners is always our number ofoffenders released on parole accounted for about2%, Thus, because of the low parolerate, efficient penalty system does not fully play its proper function, resulting in a prisonincreased regulatory pressure, the national executioner waste of resources, regulatorysites fiscal spending not being effectively reduced, and the criminals---this specialgroup of labor resources---not being used for the community to adapt to many of thesocial problems of the social difficulties after a prisoner is released. In view of these,The writer will have a typical case and survey data to conduct in-depth analysis toidentify the common problems of our parole system in the execution philosophy,specific content, practice running and objective analysis of the causes of the problem,and propose to improve the parole system specific initiatives.This paper is divided into three parts. The first part identifies eight problems of ourparole system through analyzing the typical case and data. The second part analyzes thecauses of our parole system problems from the following five aspects---the penaltyretribution concept deeply rooted in our law enforcement, public vague understandingof the parole system and low tolerance parolee recidivism, the inexperienced parolesystem in our country founded and run in shorter time, and our legislators, lawenforcement not paying enough attention to the parole system. The third part providessome specific measures to improve our parole system. The personal insights are putforward based on the following four aspects---a brand new concept to guide the thereform of the parole system, criminals re-offending risk assessment contains specificcriteria, getting through the parole system applies, and reconfiguring our parole of offenders on parole substantive conditions.更多还原
