【摘要】 随着国际国内理论界对利益冲突问题的深入研究,公职人员利益冲突问题越来越得到政府、学者以及公众的关注。由于公私利益的模糊性,利益冲突成为一个隐伏的难题,利益冲突的发生往往很难识别,因此,对于利益冲突进行管理也就更加困难。国际社会将利益冲突作为一个廉政名词,普遍认为公职人员利益冲突是腐败的最重要根源之一,如何有效地预防利益冲突是治理腐败的重要措施。本文是以公职人员的利益冲突作为研究对象。首先收集和整理了国内外的相关文献,在前人学术成果的基础上,对利益冲突的基本涵义做出界定,认为利益冲突是指公职人员的私人利益与其公职所代表的公共利益之间的冲突,其本质是一种伦理困境。本文以理性经济人假设、寻租理论作为理论基础,认为常见的公职人员利益冲突预防制度工具主要有四种：利益冲突回避制度、财产申报制度、公职人员公务外活动限制制度、公职人员离职后行为限制制度。同时分析了利益冲突制度与治理腐败的关系。实际上,公职人员利益冲突不仅会引发腐败,还会导致公共政策的偏失、政府公信力下降等一系列问题。本文重点对公职人员利益冲突问题作政策研究,从现行政策制度入手,搜集和整理了我国自改革开放以来的主要利益冲突制度,并对域外其他国家和地区,重点是美国、加拿大、中国香港、中国台湾等地的相关法律法规进行详细的归纳比较,在此基础上分析了我国现有制度存在的缺陷和不足,并提出了我国公职人员利益冲突预防制度完善的路径和方法。更多还原

【Abstract】 With the further research on the conflict of interest by the international and domestic theoretical circles, the public officials’conflict of interest problem gets more and more attention from the government, scholars and the public. Due to the vagueness of the public and private interests, conflict of interest becomes a hidden problem. Therefore, it is difficult to distinguish it. The international community sees the public officials’conflict of interest as the most important source of corruption, and thinks that to prevent interest conflicts is the root and one effective strategy management to control the corruption.This paper takes the public officials’conflict of interest as study object. This paper defines the public officials’conflict of interest through the basic meaning, and points out that interest conflict is a unique ethical dilemma between public interest and private interest. Based on the rational economic man supposition and the rent-seeking theory the theoretical basis, there are four main kinds of tools on anti-circumvention of interest conflicts of public officers, they are respectively challenge system, assets handling system, property declaration system and public officials’behavior limit system. This paper constructs the theory frame of the prevention of interest conflicts, and example analyses the interest conflicts in the different performance of our country, and analyses the status quo of prevention institution of the interest conflicts in China. At the same time, this paper analyzes the relationship between the conflict of interest system and corruption.In fact, the public officials’conflict of interest not only can cause corruption, but also lead to the lack of public policy, lured to public trust of government decline and other series of problems. This paper focuses on the current policy and collects the main system of our country since reform and opening up. According to make a detailed summarized on the related rules of the outside countries and regions, especially the United States, Canada, Hong Kong, Taiwan area, analysis the existing systems’flaw and insufficiency of our country. At last, this article puts forward perfect path and method of the prevention institution of interest conflicts.更多还原
