【摘要】 随着我国市场经济的高速发展,食品药品领域掺假售假等违法违规案件成扩大化和复杂化趋势,食品药品安全形势日益严峻,人民群众渴望饮食用药安全的诉求与日俱增,食品药品监管任务更加繁重。食品药品稽查执法是食品药品监管工作的重要组成部分和有力手段,肩负维持食品药品市场秩序、保护医药经济健康发展、维护人民群众饮食用药安全的神圣职责。食品药品稽查体制是保障食品药品稽查工作顺利开展的基础,包括稽查机构和职能设置、稽查资源配置状况、食品药品法律法规体系、稽查工作运行机制等基础性因素。2008年大部制机构改革后,我国国家、省、市、县四级食品药品稽查体制初见雏形,但由于成立较晚,加之各种先天不利因素,我国食品药品稽查执法体制整体基础还比较薄弱,呈现机构设置不合理、资源配置不足、运行机制不完善、法律法规保障体系不健全等问题,已经阻碍和影响了食品药品稽查执法工作的开展。因此,在新的形势下,为了进一步提高食品药品稽查工作效能,更好地保障人民群众的饮食用药安全,必须要认真、深入地研究现阶段如何完善和加强我国食品药品稽查体制建设。本论文综合运用多种研究方法,首先通过查阅国内外相关文献,从前人的研究中总结食品药品监管及稽查执法的理论观点,对我国食品药品稽查体制产生的背景、现状、存在问题及成因等做了深入的调查、思考和论证分析,结合自身工作体会和所学公共管理学理论知识,从再造机构设置,优化队伍、资金、装备、技术等资源配置,健全法律法规体系,强化配合联动机制、监督问责机制、考核评价机制、信息披露机制、社会参与机制等四个大的体制要素方面,提出完善我国食品药品稽查体制的对策与建议。希望本文能成为前人相关理论研究的良好补充,同时为不断优化我国食品药品稽查体制,促进食品药品稽查事业发展起到积极地促进作用。更多还原

【Abstract】 Along with our country market economy high speed development, food and drug fields such as counterfeits adulterate illegal case into extensification and complicated trend, food and drug safety situation becomes increasingly serious, the people’s desire to diet medication safety appeal grows day by day, food and drug supervision more onerous task. The food and drug inspection law enforcement is food and drug supervision work is an important part of and powerful means, shoulder maintain food and drug market order, protect medical economic healthy development, maintain the people eating the sacred duty of drug safety. The food and drug inspection system is the guarantee food and drug inspection work smoothly carry out the foundation, including audit institutions and function setting, audit resource allocation situation, food and drug laws and regulations system, audit work operation mechanism and basic factors. The super-ministries institutions in2008after the reform, China’s national, provincial, municipal and county level4food and drug inspection system prototype first sight, but due to the established late, together with various natural factors, China’s food and drug inspection law enforcement system overall foundation is still relatively weak, present institutional setup is not reasonable, the allocation of resources insufficiency, the operation mechanism is not perfect, laws and regulations guarantee system not perfect and so on the questions, have block and influence the food and drug inspection law enforcement work development. Therefore, in the new situation, in order to further improve the food and drug inspection work efficiency, and better safeguard the people’s diet medication safety, must be careful and thorough research at present how to perfect and strengthening our country food and drug inspection system construction.This paper comprehensive use of various study methods, first by looking at the related literature at home and abroad, the former research summing up the food and drug supervision and audit law enforcement theory viewpoint, to our country food and drug inspection system of the background, present situation, problems and reasons and so on has made the thorough investigation, thinking and demonstration analysis, combined with their own work experience and learn the public management theory knowledge, from the institutional setup, optimization of the team, capital, equipment, technology and so on the allocation of resources, perfect the laws and regulations system, strengthen the fit linkage mechanism, supervision and accountability mechanism, evaluation mechanism, the information disclosure mechanism, social participation mechanism and so on four big system elements, the paper puts forward perfect our country’s food and drug inspection system of countermeasures and Suggestions. We hope that this paper can be a previous related theoretical study good supplement, at the same time to continuously optimize Chinese food and drug inspection system, promoting food and drug inspection career development play a positive role in promoting.更多还原
