【摘要】 信用卡作为一种方便、快捷的现代化金融电子产品，给人们生活带来了很大便利。伴随着信用卡使用量的增多，信用卡纠纷数量也日益增多。而这些问题的产生很大程度上与银行提供的信用卡章程或者领用合约有关。国内信用卡产业在迅猛的发展，然而一系列法律规范、制度却未及时跟上，没有一部权威的法律来规范信用卡业务。因而信用卡业务发展的很混乱，导致了大量信用卡诉讼的发生。造成这一现象的原因固然与各大银行过度发卡和消费者金融风险意识薄弱有关，但我们更要从制度入手来发现问题的根源。因此，本文从信用卡格式合同的视角围绕信用卡透支后利息计算方式问题、被冒用风险责任由谁承担、如何承担以及如何平衡作为消费者的持卡人所应享有的抗辩权利来展开叙写，最后再结合我国目前的立法状况提出笔者的几点立法意见。只有从作为问题源头的“格式合同”来把关，持卡人才能更深刻的理解并合理的使用信用卡，享受信用卡所带来的便捷。更多还原

【Abstract】 Credit card as a convenient, fast and modern financial electronic products, hasbrought great convenience to people’s lives. Accompanied by the increasing in creditcard usage, the number of credit card disputes is also increasing. The emergence ofthese problems largely is related to the charter of the bank to provide credit card orusing form contract. Domestic credit card industry is in rapid development. However, aseries of legal norms have not kept pace with the development.There is no oneauthority law to regulate the credit card business. So the business of credit card isunstandard.Therefor this phenomen leds to the occurrence of a large number of creditcard litigation. The reason for this phenomenon is related to the banks over card issuersand weak consumer awareness of financial risks. At the same time we should find thekey problems of the contract. Therefore, this article from the perspective of the creditcard format contract focuses on the credit card overdraft interest calculation method,fraudulent use of risk responsibility who will bear, how to take and how to balance theright of defense that should be enjoyed as a consumer cardholders. Finally combinedwith current state of legislation author proposed legislative advice. Only resolving theproblem of the "form contract" as the source of the problem, can the cardholder be moreprofound understanding and rationally use of credit cards, enjoy the conveniencebrought about by the credit card.更多还原
