【摘要】 信息社会中公众对通信质量需求的高涨，促使搭建通信网络的基站数量不断增长，而潜在的电磁辐射隐患则又引起公众对健康的担忧。为协调不同利益群体关系，给予基站设置中各利害关系人充分表达其利益诉求的途径显得尤为重要，公众参与制度正是这样一种途径，而目前该制度在我国基站设置中的实践状况并不理想，仍有可拓展空间。在基站的设置过程中存在多种法律关系及利益类型，具体表现为公众利益、通信企业利益以及行政主体利益，这为基站设置中公众参与制度的建构提供了基础条件。第二部分对基站设置中公众参与的现有法规范进行梳理，主要涵盖在宪法、法律、行政法规及各地政府规章中。同时以上海为例，从基站规划编制和基站设置许可中的公众参与实践状况来剖析公众参与在基站设置中的现有制度结构，以期找到其中可拓展的空间。基于基站设置中不同参与者的利益及性质差异，探讨公众参与的制度性可能就成为必要。根据上海市的实践，基站设置可分为行政规划和行政许可两个阶段样态，通过分析每个阶段的利益冲突和公众参与资格，以具体探求不同阶段中公众参与的制度性可能。在分析了基站设置中的法律关系和公众参与现有制度结构后，总结出其中公众参与的制度性可能，以期对我国在这方面法律的进一步完善及实践中更好的施行这一制度具有指导意义，同时对可能扩展到其他领域公众参与理论的研究贡献智识。更多还原

【Abstract】 Along with the higher demands of communication quality of the social public in the information society, consequently, the number of stations providing communication network services is also rising quickly, however, the hidden danger to health of the underlying electromagnetic radiation has come to public concern. In order to coordinate the relationships among the groups of different interests in settings of mobile communication stations, it is necessary to give the different interested parties the way to fully express their demands. Public participation system is such a kind of way, whose condition in station settings is not ideal in China, and there is still some space to improve.There are several legal relations and interests type in the setting process of mobile communication station, which include interests of the public, communication enterprise and administrative authorities, so that provides the prerequisite to the construction of public participation system in station establishment. There are already regulations and applications of public participation in China’s present laws and practice. The second part of this paper is a collection and analysis of existing rules and regulations of public participation in station settings and it will also give an analysis of the present system structure of public participation in station establishment from station planning and concrete setting procedure the two aspects in hope of finding some space to develop. There are several communities of interests caused by different positions in station settings, and on this basis, the communities have the possibility to engage in public participation. According to the practice in Shanghai, the procedure of station setting can be divided into planning and administrative licensing, this paper will explore the institutional possibility of public participation in the two stage through analyzing conflicts of interests and qualifications of public participation.On the basis of the analysis of legal relations and present structure of the system in station settings, to give a conclusion of the institutional possibility of public participation so as to provide some guidance to perfect the laws in this respect and enforce the system better.
