美国反补贴措施应对研究

【摘要】 反补贴措施作为世贸协议框架下的贸易救济手段之一,由于直接剑指政府经济政策,实质隐藏着对中国政府产业政策乃至经济政策的牵制作用。自2004年加拿大政府对华启动首例反补贴措施以来,美国、欧盟纷纷加入对中国采取反补贴措施的行列。甚至连南非、墨西哥这样的发展中国家对中国也已小试牛刀。本文所研究的领域仅限于美国政府针对涉华产品所提起的反补贴措施,我国企业如何应对,如何利用美国国际贸易法院对政府贸易保护措施的司法审查制度寻求司法救济以及在此过程中政府如何发挥管理、服务职能,维护民族企业和产业利益的最大化,维护国内经济政策的稳定性和自主性。本文共分四部分。第一部分从反补贴措施的概述及其市场经济理论基础方面论述,提出中国产品应对反补贴措施调查必须树立新的完全市场经济理念。第二部分通过案例分析美国对华产品采取反补贴措施的历史演变,美国对华产品采取反补贴措施的现状,我国政府和企业在应对方面存在的问题等等。第三部分从实体抗辩和程序策略方面探讨如何应对美国商务部和国际贸易委员会提起的反补贴调查。第四部分主要论述我国政府应对美国反补贴措施过程中如何发挥政府职能作用,组织、引导企业应诉和起诉,保护民族产业安全。更多还原

【Abstract】 By the reason of subject to the government policy, the countervailing,being the most effective WTO trade protection, hold down the Chinese government economic policy. The USA, with the European communities, exam Chinese product with subsidy, following the Canada government, which sue China in 2004. More and more developing country are now take part in this group in against to Chinese product.This article,discussing the Chinese enterprise answer the USA government countervailing investigation against to Chinese product, taking advantage of the USA International Trade Court(ITC)’s judicial review, to protect the national industry beneficial, and the stability, alone with the independence of the government policy. The article has four sections.The first section is a summarize of the countervailing and its basic theory about market economic, and the necessity for China to build the new market economic idea.The second section is about the history of the USA countervailing cases, what is the actuality, and the problem with answer the investigation against Chinese government product.The third section discussing how to answer the countervailing investigation both on countervailing and procedure.The last section discussing the Chinese government perform his functions, organize guide the enterprise to sue and answer the USA government, and provide the safeguard for national industry.更多还原
