【副题名】以成都地区为例

【摘要】 刑事法律援助是指在刑事诉讼中国家对某些经济困难或特殊案件的当事人减免诉讼费用并提供法律帮助的一项法律制度。目前刑事法律援助制度已被世界上绝大多数国家所接受并被作为一项保障公民权利的原则载入了世界《人权公约》。刑事法律援助已经成为现代国家对本国公民必须承担的一项维护基本人权和追求司法公正的国家责任。具体而言刑事法律援助的制度价值主要可以体现在以下几个方面：首先,体现了“法律面前人人平等”的原则。其次,维护了控辩平衡并保障了司法公正的可能性。最后,有利于社会保障体系的完善。1994年初,我国司法部正式提出了建立法律援助制度的设想。此后,一方面组织有关法律援助制度的理论研究和可行性论证,另一方面提倡在有条件的地方率先实行法律援助的试点工作。1996年《刑事诉讼法》和《律师法》的修改为刑事法律援助工作的开展提供了法律依据。随后,刑事法律援助不断发展,至今已有十余年。我国的刑事法律援助工作取得骄人成绩的同时也出现了一些问题,包括立法层面和实践层面的问题。就成都地区而言,从1996年成都市法律援助中心成立至今已经14年,在这十余年中成都地区的法律援助工作得到了很大的发展,取的了一些成绩,但也存在不少的问题亟待解决。本文通过调查报告的形式,着眼于分析成都地区刑事法律援助的运行状况以及存在的问题,提出了完善刑事法律援助的几点思考。本文主要内容可以分为一下四个部分：第一部分,导论。本部分主要是介绍本文研究的目的意义等内容,具体包括问题的提出、文献综述、研究的方法和情况说明、调查报告的思路等方面。第二部分,成都地区刑事法律援助的运行状况。本部分内容主要是分析成都地区刑事法律援助的主体、成都地区刑事法律援助的范围、成都地区刑事法律援助的资金保障、成都地区刑事法律援助的案件办理情况、成都地区刑事法律援助的宣传工作、成都地区刑事法律援助的发展这六方面内容。第三部分,成都地区刑事法律援助存在的问题。基于第二部分对成都地区刑事法律援助运行状况的分析,找到成都地区刑事法律援助存在的一些问题,并对其进行简单的评述。第四部分,针对成都地区刑事法律援助问题的完善建议。结合前面的内容,针对成都地区刑事法律援助存在的问题提出一些完善的建议,主要有六个方面的建议,包括对成都地区刑事法律援助主体问题的建议、解决成都地区刑事法律援助经费问题的建议、提高成都地区刑事法律援助办案质量的建议、改善成都地区刑事法律援助宣传工作的建议、针对成都地区刑事法律援助供需矛盾的建议、针对成都地区法律援助机构与相关部门在刑事法律援助案件中衔接机制不顺畅,法律援助与司法救助不协调的建议。更多还原

【Abstract】 Criminal legal aid system means countries reduce and remit fees to provide criminal legal service for poor clients and clients in special cases. Criminal legal aid system has been accepted by most nations now, and Universal Declaration of Human Rights holds it as a principle to safeguard human rights. Contemporary countries have the responsibility to carry out criminal legal aid for people so as to safeguard basic human rights and pursue justice.The merit of criminal legal aid system includes following three aspects:firstly criminal legal aid system embodies the principle of "equality of all people under law". Secondly it is necessary for maintaining the balance between the accused and the prosecution and realizing justice to set up criminal legal aid system. Finally, criminal legal aid system is important to consummate social guarantee system.In early 1994, China’s Ministry of Justice formally proposed the idea of establishing a legal aid system. Since then, the organization of the legal aid system on the one hand the theoretical study and feasibility study, on the other hand to promote the implementation of the conditions of legal aid where the first pilot. 1996, "Criminal Procedure" and " Lawyers Law " was revised to criminal legal aid work carried out to provide a legal basis. Subsequently, the continuous development of criminal legal aid, has been more than ten years. China’s criminal legal aid work, while the success there have been some issues, including the legislative level and practical dimensions. To Chengdu, the Chengdu legal aid since 1996 has been 14 years since establishment, in which more than ten years of legal aid work in Chengdu has been greatly developed, taken some results, but there are many problem to be solved. This paper survey forms, focus on the analysis of criminal legal aid in Chengdu operating conditions and problems, by improving the criminal legal aid Thoughts, In this paper, the content can be divided into about four parts: The first part, Introduction. This section mainly describes the purpose of this meaning of the content, the specific issues raised, including, literature review, research the meaning and purpose, the paper thought so.The second part of the criminal legal aid in Chengdu operating conditions. This section is mainly of Chengdu’s main criminal legal aid, criminal legal aid in Chengdu the scope of criminal legal aid in Chengdu financial security, Chengdu handling cases of criminal legal aid cases, criminal legal aid in Chengdu publicity work criminal legal aid in Chengdu these six aspects of the development.The third part, Chengdu criminal legal aid problems. Based on the second part of the criminal legal aid operation in Chengdu analysis of the situation in Chengdu criminal legal aid to find some problems.The fourth part, for criminal legal aid in Chengdu suggestions of improvement.
