【摘要】 社会调查制度是运用于未成年人刑事案件中,旨在通过对未成年人相关因素的调查反映未成年人实施犯罪行为的内在原因,而所调查的与未成年人相关的因素就是社会调查报告的内容。社会调查报告内容是社会调查制度的重要环节,调查内容的准确性与科学性决定了社会调查制度能否有效地的运行。以发现未成年人犯罪原因为目的确立的社会调查报告内容,其理论依据也应与未成年人犯罪原因论相一致。目前我国通过对未成年人各方面的因素进行调查,总是不加分别的作为罪轻的依据,而忽视了未成年人犯罪原因的分析,使调查内容肤浅且形式化。文章主体以社会调查报告应调查的内容为核心问题,从以下四个方面展开研讨。首先,该部分从社会调查制度入手引出本文研究的核心,即社会调查报告内容,论述了研究社会调查报告内容的价值,分析了与社会调查报告内容相联系的未成年人犯罪原因论的国内外相关理论,以及关于社会调查报告内容的国内外相关法律规定,进而分析社会调查报告内容存在的问题。其次,分述家庭因素作为社会调查报告内容的主要方面,通过对家庭结构、教育方式等方面进行调查,分析在未成年人实施犯罪行为时,家庭方面的原因。然后,分述学校教育因素作为社会调查报告内容的主要方面,在未成年人实施犯罪行为中存在的消极因素。学校教育形式、方法、管理等漏洞都会对未成年人犯罪行为产生影响。最后,分述其他一些因素作为社会调查报告内容的方面,在未成年人实施犯罪行为中存在的消极因素。如不良的社区环境、不良交往以及其他未成年人自身存在的消极特征也是造成未成年人犯罪行为发生的原因。更多还原

【Abstract】 Social investigation system used in juvenile criminal cases aims at reflecting the underlying causes of criminal behavior the minors commit, through the investigation of factors associated with the minors. And these factors are the social investigation reports’content. The content is an important part of social investigation system, and the scientific and accuracy of the content determines the effective running of social investigation system. The theoretical basis of content which target at discovering the causes of juvenile should be consist with the causes of juvenile delinquency.This paper take social investigation reports’content as the core problem, and discuss it from the following four points.First of all, this part which starts from the social investigation system leads to the core of this paper, that is the social investigation report, discusses the value of social investigation reports’content, analysis on the theory at home and abroad of the reasons for juvenile delinquency which contact with social investigation reports’content and on the social investigation report of the domestic and foreign laws, and then analyzes the problems of the social investigation reports’content.Secondly, this part carries out family factors which are described as the major aspect of the report. Through the investigation of the family structure, education and other aspects, analysis the family reasons of crime in the minors.Then, this part is described the factors of school education which will play the negative role in juvenile delinquency. Some flaws as school education, forms, methods, and management etc., will impact on juvenile crime.Finally, this part is described some others aspects which will impact on juvenile crime. Such as poor community environment, harmful communication, and the negative factors existing in minors themselves and so on are the causes of juvenile criminal acts.更多还原
