【摘要】 近年来,随着我国交通运输业的发展,尤其是20世纪90年代以来,社会经济的迅猛发展,进而公务用车和私人汽车拥有量大幅增长,交通肇事案件随之逐年增多,交通肇事逃逸案件也呈日益上升趋势,严重危害了人民群众的生命健康和财产安全。交通肇事也成了目前我国司法实践中常见且多发的违法现象,特别是交通肇事后逃逸现象屡见不鲜,不仅严重违法了交通规则制度,也扰乱了社会公共秩序,而且还给人们的生命健康安全和财产安全造成了严重威胁,给国家造成了巨大的经济损失,也给社会造成了严重的社会危害。为了严厉打击此种危害行为,1997年刑法将“逃逸”和“因逃逸致人死亡”分别规定为交通肇事罪的加重情节,最高人民法院《关于交通肇事刑事案件具体应用法律若干问题的解释》也对两者含义以及相关的罪质认定问题亦作出了界定,这为“交通肇事逃逸致人死亡”的逃逸行为的罪质认定问题提供了法律依据,但在这种特殊的情形下,司法解释仍然不能满足实践的需要,从而使刑法在理论界上与实践中都存在非常大的争议,极大地影响了本规定在司法中的正确适用。然而,立法的简略和《解释》的缺陷,己经严重地影响到交通肇事逃逸案件的司法处理,在实践中带来很大麻烦,在理论界也引起很大的争议。为此,本文就“交通肇事逃逸致人死亡”相关问题进行分析并予以探讨。因此有必要对我国的刑事立法予以修改和完善,使其更好地发挥功能。更多还原

【Abstract】 In recent years, along with our country transportation shipping industry development, Since especially social economy rapid development in the 1990s, official business grows largely with the vehicle and the private car capacity, the transportation cause troubling case increases year by year along with that, the transportation cause troubles the escape case also to assume day by day the trend of escalation, severely impair people’s life health and property security.The transportation cause troubled has also become in the present our country judicature practice common, and sent illegal phenomenon, after specially the transportation cause troubles, escapes the phenomenon to be common, not only serious illegal traffic regulations system, but also harassed the social public peace and order, moreover has posed the threaten seriously safely to people’s life health safety and the property, it has created the huge economic loss to the country, also has caused the serious social harm to the society.To attack this kind of harm behavior severely, because in 1997 the criminal law“the escape”and“will run away the elegant tastes person to die”were stipulated separately for the transportation cause troubling crime’s aggravation plot, the Supreme People’s Court "Cause troubled Criminal case Concrete Application Law Certain Question Explanation about Transportation" also to both meaning as well as the related crime nature recognized the question has also made the limits, thus has provided the legal basis for the recognition of escape behavior crime nature“Cause troubles for the transportation runs away the elegant tastes person dies”, but under this special situation, the judicial interpretation still could not satisfy the practical needs, thus causes the criminal law to have the very great dispute in the theorists with the practice, has affected this stipulation enormously in judicature’s correct being suitable.However, legislation brief and "Explanation" the flaw, oneself after affects seriously to the transportation cause troubles escape case’s judicial processing, in reality brings is very greatly troublesome, causes very great dispute in the theorists.
