【摘要】 权力腐败作为一种人类社会现象,或者人的一种行为,普遍客观存在于人类社会,从未被彻底根除过。从历史角度看,权力腐败已在人类社会存在了三千多年甚至更长的时间,从国际范围上看,权力腐败是世界上各个国家在经济社会发展过程中所面临的普遍问题,是世界各国政府最大的敌人；从根源上追溯,权力腐败是权力滥用所滋生出来的。权力腐败像人肌体的疾病一样,是一种社会病,随着社会发展,各种形式腐败现象就会前腐后继,肆虐政坛,对人类社会造成危害和破坏。我国实行改革开放后,经济和社会体制正在进行变革,整个社会处于转型时期,由于各种政治经济体制不健全不完善,意识形态的多元与冲突,社会分层中利益群体的复杂多样,造成现阶段权力腐败频发且形势不断恶化。中国改革开放所取得的伟大成果来之不易,如果不能有效地预防和惩治权力腐败,一切成果就可能被葬送,民族复兴大业就此会被搁浅。虽然我国现阶段反腐败工作已取得显著成效,但随着社会经济体制变革不断深入,改革开放力度不断加大,新的滋生和诱发腐败现象的因素不断出现,社会上权力腐败现象仍然严峻,反权力腐败工作任重道远。权力腐败的根源是公权力的滥用,因此,构建一种完善的驾驭和控制公共权力的法律体系,使权力运行过程处于阳光透明之下,打造阳光及透明政府,把权力腐败消除到人民所能忍受的程度不仅是政治体制改革的方向,也是惩治和预防权力腐败的明智之举。本文在一些专家学者研究的基础上,根据我国现阶段权力腐败形势,参照国际及我国实行的反腐策略,并结合我国反腐工作所取得的经验,对预防与惩治腐败提出了一些构想和建议。首先,本文对权力及腐败本身的内在特性进行了法律界定,从而对分析中国转型期权力腐败特征和诱因,提出预防与惩治腐败的合理化建议打下了理论基础,然后对转型期权力腐败所呈现出来的新特征及造成权力腐败多发横行的原因进行了概括和描述,接着针对现行预防和惩治腐败法律制度设计中存在的问题和缺陷,提出了自己的一些完善预防和惩治腐败法律制度的构想和建议,以期对我国的反腐事业有所裨益。更多还原
