【摘要】 “依法执政”是一个备受国内外广泛关注的政治哲学理念。“法治”思想作为人类的文明成果,无论在西方国家还是在中国同样适用。中国是一个具有严重封建思想的文明古国。随着社会发展,虽也认识到了“法治”的重要性,并积极地进行了一些体制改革,但从“人治”走向“法治”,还十分困难。改革开放以来,是中国走向现代意义的社会主义法治社会的一个关键转折点。从“依法治国,建设社会主义法治国家。”治国方略的提出,到“坚持依法执政”,都足以证明法治的观念已全面深入人心。建立起一套与时俱进,适应我国国情的执政方式——“依法执政”是执政党的必由之路。什么是依法执政,中国共产党自执政以来的执政方式,及共产党应该如何依法执政是本文主要思路。真正的法治国家,要求不能有凌驾于法律至上的个人和组织,包括执政党在内。中国共产党既要发挥其领导作用,又要处理好党与法的关系,不能以党代政,凌驾于法律之上。同时国家机关要依法行政,畅通人民行使选举与被选举权的道路,完善监督机制,创新干部选拔任用体制等等,都严格按照法律程序来实行。只有这样,才能真正实现人民的根本利益,防止腐败和大的决策失误,稳定党的领导地位。宪法和法律是执政党的行为准则。执政党执政行为和领导行为同样要受到法律限制。更多还原

【Abstract】 “Control political power according to law”is a political and philosophical idea which is paid close attention by both at home and abroad. As an achievement of political civilization of human beings, it can be used not only by the western countries, but also by the China. China is a Feudal state. With the development of social, although“rule of Law”is important, form“Rule of men”to the“rule of Law”is difficult.Since the policy of reformation and opening began to implement, China take a big stride towards modern socialism. From‘administer the country according to law and try to build a legal state of socialism’to‘persist in the reign in accordance with the law’, all proves that the idea of“Rule of Law”has been supported by people. So“Reign in Accordance with the Law”, which can keep pace with the times and that can adapt to the conditions of our country, is created is our way.What is‘persist in the reign in accordance with the law’, the CPC about the way to be in power, and how to‘persist in the reign in accordance with the law’. A true legal state, can not have supremacy above the law required individuals and organizations, including the ruling party. Communist Party of China should not only play its leadership role, but also properly handle the relationship between the Party and the law. Can not party on behalf of the government, is above the law. State organs at the same time to administration by law, the exercise of the election and be elected smooth roads, improve the supervision mechanism, innovative cadre selection and appointment system and so on, all in strict accordance with legal procedures to implement. The only way to truly realize the people’s fundamental interests, prevent corruption and big policy mistakes, and stability of party leadership.
