【摘要】 凯尔森创立的纯粹法学是法学理论中的一座里程碑,在为法律争取独立地位的过程中,他不仅与其他实证主义法学家一道划清法律与道德的界限,而且还建构了比前人更加严密的法学理论,为法律理论的发展做出了卓越的贡献。纯粹法学的核心就是基础规范,对此人们有很多争论。本文首先探讨了基础规范的理论背景,这主要从三个角度来探讨,一个是纯粹法学多元化的哲学根基,一个是该理论建构的方法论,还有构建过程中的反意识形态立场;其次阐述了对基础规范的相关认识,包括基础规范的作用、内容和性质;最后就基础规范的相关批判做了几点追问,包括法律体系的同一性问题、规范的纯粹性问题和规范认识主体问题,以求更加透彻地理解基础规范。更多还原

【Abstract】 The pure theory of law established by Kelsen is a milestone in the jurisprudence. In the process of defending the independence of law, he not only illustrates the relation between law and moral just as other law positivists, but also construct a more accurate theory which contributes to the jurisprudence brilliantly. The core of pure theory of law is the basic norm, which has intrigued many controversies. And this treatise explores the background firstly from three aspects: the vary philosophies of the pure theory of law; the scientific method of constructing the theory and the attitudes of anti-ideology in the theory. Then it makes a research about the basic norm about its functions, content and nature. At last, the monograph makes some contrary comments on the critics to the basic norm for a thorough understanding about it in three points: the unity of legal system, pureness of norm and subjects recognizing norm.更多还原
