开放条件下的金融监管研究

【摘要】 随着2006年12月11日《外资银行管理条例》的正式生效,作为我国金融业核心领域的银行业在地域、业务种类、客户对象等各个方面对外资银行全面开放,标志着我国加入WTO后五年保护期的结束。而随着我国经济的不断发展、国力的显著增强、对外开放的逐步扩大,金融监管体现出越来越重要的作用。金融全球化在促进世界经济发展的同时还带来了巨大的风险,一方面,它加剧了金融体系固有的风险,另一方面,使金融风险在各国之间迅速传播,从而加大了全球性金融危机发生的可能性。全球性的金融风险构成了国际统一监管的现实基础,同时也使金融监管的危机导向特征更加明显。开放条件下的金融监管在监管对象、监管内容、监管方式、监管体制及监管范围等方面都表现出与传统金融监管不同的特点。使得金融监管的范围更广,内容更加深入复杂,金融监管所采用的方式也发生变化。而在开放条件下金融监管体制的选择则取决于各国的金融市场结构、金融经营方式等内在因素和各国政治制度、文化传统和经济体制等外生因素的共同作用。现行的监管模式以机构监管为主,但是由于功能性监管能够更好的满足金融业发展的需要,越来越多的国家正在逐步向这一方向过渡。对我国而言,我国在金融开放过程中取得了一定成果,但面对金融业的不断开放,我国的金融业还要经历更多的挑战。一个是为规避金融监管而变革传统的管理制度所形成的新的市场行为,即金融创新。金融创新在规避监管的同时增大了金融系统的不稳定性,并且改变了金融系统运作的基础条件,导致金融监管主体的重叠与缺位并存。另一个是混业经营的发展对金融监管产生了较大的冲击。金融机构经营界限的模糊,混业经营的外资金融机构以其成熟多样的金融产品、先进的经营模式、丰富的管理经验给我国金融市场带来巨大的影响,加之我国尚未建立起有效的制衡、协调机制,对混业经营特别是外资金融机构的监管是我国金融监管体系必须解决的重点和难点。而面对这种情况,我国的金融监管应采取有效对策。一是要转变监管理念,有效控制风险,从而提高监管水平;二是从法律法规体系重视金融监管,做到立法明晰、执法准确,强化金融监管功能;三是适应变化形势,加强监管创新,变被动监管为主动监管;四是根据形势需要,加强监管机构间的协调合作机制,这不仅是要求国内监管机构的合作,同时还要加强国内与国际间监管机构的协调,从而适应金融全球化发展的要求。
【Abstract】 With the December 11,2006, "the management of foreign banks" take effect, as the core of China’s financial industry in the geographic areas of banking, business types, the target customers, and other aspects open to the foreign banks, which is marking the end of 5-year protection period after China entry into the WTO. Along with the constant development of our economy, our overall national strength has markedly increased, and gradually open to the outside world, the financial supervision has been more and more important. Financial globalization not only promotes the world economic development, but also brings great risks. On one hand, it intensified the risks inherent in the financial system, on the other hand, the financial risks spread rapidly among countries, thereby intensifying the possibility of global financial crisis. Global financial risks posed a unified international supervision realistic basis, as well as financial supervision and crisis-oriented features become more pronounced.Under the open condition, the supervision of financial in regulatory targets, regulatory contents, regulatory manners, regulatory systems and scopes take different characteristics with the traditional financial supervision. The open of the financial industry makes the scope of the financial supervision much wider, the content much deeper and more complex, and financial supervision by the way, have also changed. While in the financial supervisory system under the open condition depends on the internal factors, such as the structure of the financial markets, financial management, and also the common role of exogenous factors, such as the mode of political systems, cultural traditions and economic systems. The most of the existing regulatory models is institutional supervision, but because of functional supervision meet the needs of financial development better, more and more countries are gradually transition to this direction.For China, our country achieved certain results in the process of financial liberalization, but in face of the opening, China’s financial industry will experience more challenges. One is Financial Innovation, which is first used to avoid financial supervision. Financial Innovation in regulation increase the instability of the financial system, change basic conditions of the operation of financial system, then resulting the absence or overlap in financial supervision. Another one is the development of mixed operations. The businesses has been more and more vague, foreign institutions bring along with lots of mature products, and the of advanced operation mode, full of the management experience, impact on China’s financial market, and China have not yet established effective coordination mechanisms. The supervision to Mixed Operation, particularly the foreign institutions, is the focus on solving the difficulties of China’s financial supervision system.In the face of such a situation, our country’s financial regulators should take effective countermeasures. First, we must change our concepts on supervision, to strengthen the management of risk, thereby enhancing the level of regulation. The second, improve the law and regulation system of financial regulation, make it clear in enforcement, and strengthen financial supervision functions. The third, adapt to the changing situations, strengthen regulatory innovation, change passive to active regulatory supervision. The last, in accordance with the needs of the situation, strengthen the coordination mechanism among regulators, which not only requires domestic coordination, but also the international coordination among regulatory agencies, thereby to meet the requirements of the development of financial globalization.
