【摘要】 随着城乡二元格局的打破,越来越多的农村农民市民化,乡村的居民也渐渐减少,这是不可否认的事实。但是这一进程中还有诸多的问题尚未解决,农村农民宅基地的流转就是一个突出的问题,宅基地使用权这个具有中国特色的法律词汇,具有着特殊的内涵,在我国农村宅基地有社会保障的性质,在目前的现状下可以说这是农民为数不多的社会保障,在我国农村有“修房养老”之说,可见宅基地在农民心目中的地位,然而城市化的进程中却存在着一个两难问题:一方面宅基地的需求越来越少,另一方面土地资源却越来越珍贵,并且这一趋势越来越明显。针对宅基地使用权流转的研究在目前的情况下很有必要,从目前的立法现状来看,宅基地使用权的流转仍然受到限制。第一部分从目前农村存在的突出问题出发,分别给予叙述,目前我国农村存在宅基地流转受限、土地利用不合理、一户多宅、小产权房等诸多问题。第二部分针对第一部分存在的问题,分析了原因,概括起来这些原因包括:一、立法缺陷,现有的法律严格限制宅基地流转,宅基地流转市场没有建立。二、产权制度原因,集体所有权强化虚拟的主体地位,一个强集体一个弱个人的局面明显。三、历史传统原因。第三部分通过原因的分析进而为下文的改革思路提出建议。一是强化农民的主体作用,把农民的权益真正落实到位,使农民在宅基地上享有民事主体地位。二是改革农村土地制度,改革宅基地使用权是一项系统工程,因而需要诸多的制度支持,比如宅基地登记制度的健全、农民集体成员权的保障等等。三是理顺产权关系,形成一个有进有出的宅基地流转市场。更多还原

【Abstract】 With the dual urban-rural structure of break, more and more rural peasant’s citizenship. It was undeniable fact that the number of peasant were reduce. There were many problems need to be solved, It is clearly pointed out that the rural reform and innovations should be vigorously paid attention to the homestead right of use. The homestead right of use has a special meaning in a society of rural. "Revised Housing Endowment," said the homestead can be seen standing in the eyes of farmers. However, there is a dilemma: on the one hand ,the less and less people need of house-site; on the other hand, the more and more precious land resources, and the trend is more and more obvious. It was necessary that land use right circulation research in the present situation. from the current legislative status of view, the transfer of land use right is still limited.The first part narrative talk about present countryside existing prominent problem. Residential Land at present there is limited rural land use, land use unreasonable, one household has many hoses, mall property right, ect.The second part analyzed the reasons, summed up the reasons: First, legislative defect, the existing laws strictly limited changing house. Second, property rights system reason, collective ownership had a strong collective a weak individual situation. Third, historical tradition reasons.The third part of the cause of reform ideas for the following further recommendations. First, strengthen the principal role of farmers. Second, the rural land system reform, reform land use right is a systematic project, which requires a lot of institutional support, such as the homestead and improve the registration system, a farmers’ collective member right safeguard etc.更多还原
