【摘要】 现行的《湖南省专利保护条例》是于2001年颁布并实施的一部地方性专利法规。条例制定的时间正处于我国地方专利立法逐步成熟的阶段,具有其特定的历史背景。该条例对湖南省专利事业的发展发挥了巨大作用。随着2008年我国专利法以及专利法实施细则进行了第三次修改,上位法对专利工作提出了新的要求,条例内容已不能满足湖南省经济社会发展的需要。条例的立法目的仅限于专利保护,尚不全面。同时条例缺少基本原则,基本体例也不清晰。另一方面,专利行政管理体系中缺少独立的知识产权管理机构而且激励与扶持等具体措施落实不到位。目前,天津市、广东省及江苏省等地区已经颁布了最新的专利条例。《湖南省专利保护条例》的修订应当借鉴这些地区最新颁布的条例内容并结合湖南省的实际情况,明确条例的立法目的是促进专利的创造、运用、保护、管理和服务。同时在激励创造、有效运用、依法保护以、科学管理以及强化服务的原则的指导下,从专利的激励、运用、保护、服务和管理这五个方面重构条例的体例框架,并在条例中增加构建专利信息服务体系,建立重大经济活动专利审议制度,建立专利纠纷行政调解司法确认机制以及将专利违法信息纳入征信系统等具体措施。更多还原

【Abstract】 Current’ Hunan Province Patent Protection Ordinance’ which is a patent ordinance promulgated and implemented in 2001.The time of setting ordinance is in a gradually mature stage of lacal patent legislation.So it has a specific historical background.As ’Patent Law’ and ’Implementing Regulations Of The Patent Law’ being revised for the third time in 2008,new requirement was proposed for patent work. Current Patent Ordinance can’t meet the needs of economic and social development in Hunan Province. The purpose of the ordinance is limited to patent protection and it is not comprehensive. Meanwhile,the basic principles are absent and the basic style is not distinct.On the other hand, the patent administrative management system is lack of independent-management agencies-of intellectual property rights and practical measures- does not reach the designated position, such as Incentive and supportive measure.At present,Tianjin,Guangdong and Jiangsu province and other regions have issued the latest patent ordinance.Revision of the ’Hunan Province Patent Protection Ordinance’ shall draw lessons from the latest promulgated ordinance of the areas and in combination with the actual situation of Hunan province.The paper points out that the purpose of the revised ordinance is in order to promote the patent create, utilization, protection management and service, under the guidance of the principles of the incentive creation, effective useness, protecting according to law, scientific management and enhance service, reconstruct the style framework from five respects that is the incentive, utilization, patent protection, the service and management, increase the construct patent information service system and the specific measures by establishing the significant economic activity review system and the patent administrative mediation judicial confirmation patent dispute and bringing the patent illegal information into the patent law credit information system.更多还原
