【摘要】 随着我国工业化、城市化和现代化进程的不断加快,越来越多的农村剩余劳动力转移到城市就业,以“农民工”的身份担当着新时代产业工人的重要角色,为城市的发展做出了突出贡献。然而,与农民工巨大贡献形成鲜明对比的是他们频繁遭遇着各类权益问题,而制度的不健全是造成这些问题的根本原因。本文正是基于这种背景对农民工权益保障制度进行了研究。本文的研究框架建立在制度分析的基础上,运用文献调研和比较研究的方法,通过检验制度性因素对农民工权益的影响提出针对性的对策建议。首先,从农民工权益问题的现状入手,通过搜集资料及对历年统计数据分析总结,对农民工在政治、经济、社会保障及教育等方面权益问题的现状进行了介绍；其次,分析造成农民工权益问题的制度性障碍。证实了户籍制度、政治制度、经济制度、社会保障制度及教育制度与农民工合法权益能否实现有着密切的关系。而且,非正式制度(如城市居民对农民工的歧视程度)与农民工权益能否实现也存在较为显著的相关性。制度对农民工权益的影响是显著的；第三,运用制度变迁理论分析农民工权益保障制度进行变迁的动因及变迁的过程。得出农民工权益保障制度变迁需要在政府的推动下完成；最后,分别从户籍制度,政治法律制度,就业制度,社会保障制度和教育培训制度的角度提出改革思路。本论文的研究得出,解决农民工权益问题的关键是要对现行不足的制度进行改革,要充分认识到户籍制度改革的必要性,政治制度、经济制度、社会保障制度和教育制度作为制度变迁过程中必不可少的环节必须与户籍制度的改革同步进行,相互协调,避免出现政策制定部门之间相冲突的现象。更多还原

【Abstract】 Along with the industrialization, urbanization and modernization process accelerating in China, more and more rural surplus labor go to city to looking for employment, as the identity of migrant workers being the important component of the industrial worker, and making outstanding contributions to the development of the city. But contrasting to migrant workers’ great contributions is kinds of rights problems they had encountered, and imperfect system is the root cause of these issues.The research of this paper is based on this background of migrant workers’rights and interests protection system, and the framework of this research is based on the analysis of system. By inspecting institutional factors’influence to migrant worker’ rights, propose pointed countermeasure. First of all, on the current situation of migrant workers’rights, by collecting data and analyzing historical statistics, introduce migrant workers’current problem of rights in political, economic, social security and education, etc; Secondly, make an analysis of the institutional reason of migrant workers’rights problem., confirmed the household registration system, political system and economic system, social security system and the education system has a close relationship with the realization of migrant workers’legal rights. Moreover, the informal institutions (as urban residents’description for migrant workers) has a significant correlation with the realization of migrant workers’rights. The influence of system to migrant workers’rights is obvious. Thirdly, use the Theory of Institutional Change to analysis the reason and the process of the changing of migrant workers’rights and interests’ protection system, and come to a conclusion that Induced Institutional Change needs to along with the government. Finally, propose suggestions to the reform of migrant workers’rights and interests protection system.This paper comes to a conclusion that the key to resolve the problem of migrant workers’ rights is to reform the insufficient system. Realize the necessity of the reform of household registration system, as indispensable link in the process of institutional change, political system, economic system and social security system and education must change with the household registration system, coordinate mutually, avoid appearing the conflict between policymaking department.更多还原
