【摘要】 情态是法律英语中表达语意的重要工具,在法律文本中其用法较为特殊,传达特定的功能,能够表达一定的言语行为。海商法文本具有法律语言的基本特点,即准确明晰,简洁凝练,严谨规范,庄重朴实。该文旨在探究中华人民共和国海商法英译本和英美海商法文本中情态的使用特点及分布规律,并对比分析其在两个法律文本中的异同。本文以Halliday的系统功能语法为理论基础,以中华人民共和国海商法英译本及英美海商法法律文本为语料建立两个小型语料库,通过AntConc和SPSS两种语言统计工具,进行定性定量的对比分析。分析显示,情态系统在中国海商法英译本与英美海商法文本中的使用存在显著差异：四种情态表达方式的使用频率均高于其在英美海商法中的使用频率；两种海商法文本均倾向于使用中值情态和低值情态,但是中值和低值情态在中国海商法的使用频率高于其在英美海商法中的使用频率；另外,显性主观和显现客观是中国海商法与英美海商法实现人际功能的主要手段,而隐形主观和隐性客观不是法律文体实现人际功能的工具。通过对比分析中华人民共和国海商法英译本和英美海商法中情态的使用特点及分布规律来研究海商法这种专业性很强的法律英语的情态使用规律,有助于准确理解英译本中国海商法条款中的权利和义务。同时,研究发现中国海商法英译本的翻译水平还有待提高,希望对教学及翻译工作者有一定的参考价值。更多还原

【Abstract】 Modality is a significant instrument for expressing semantics in legal English. It can be used to express certain speech act. The usage of modality is special and conveys specific function in legal texts. Maritime law, as an important kind of legal text, is imbedded the basic features of legal language:accuracy, strictness and logicality.This paper aims to study the similarities and differences of modality use between China Maritime Code and western maritime law and the distribution features of modality between these two legal texts. Within the framework of Halliday’s systemic-functional grammar, two small size corpuses are established with the text of CMC and WML as linguistic data. A contrast analysis is processed qualitatively and quantitatively through statistical tools such as:AntConc and SPSS.The analysis shows that there is a significant difference on the modality use between China Maritime Code and western maritime law. Four types of modality expressions are employed more frequently in China Maritime Code than that in WML; these two legal texts are inclined to adopt low and median value modality, however, the frequency of low and median value modality in China Maritime Code is higher than that in western maritime law. An addition to this, implicit subjectivity and implicit objectivity are two ways to realize the interpersonal function in China Maritime Code and western maritime law, while explicit subjectivity and explicit objectivity are not the method to achieve interpersonal function in legal text.This paper is helpful for us to obtain better comprehension of the rights and obligations in the China Maritime Code clause.
