【摘要】 财产继承制度是我国民事制度的重要组成部分。伴随着物权法的通过,我国已启动民法典的编纂工作。《继承法》也将在进一步得到修改和完善,进而纳入民法典。法定继承制度在继承领域占有绝对优势,而法定继承人的顺序又是法定继承制度的重要内容,其设计合理与否直接关系到广大人民的切身利益。因此,笔者试就法定继承顺序制度进行探讨,分析其不足,并试拟立法建议稿,供立法机关参考。本文主要包括前言、结论和正文三部分,正文分为四章,主要内容如下：第一章是概述部分。第一节介绍了法定继承人顺序的概念和特征并说明了文章研究的重点。第二节介绍影响法定继承人顺序的依据,最终得出结论：确定法定继承人的顺序的基本依据是一定社会的生产方式,民族传统习惯、宗教、社会道德观念、立法者的政策也对法定继承顺序有一定的影响；现代各国继承法确定法定继承顺序的三大依据是血缘关系、婚姻关系和扶养关系。第二章是对世界主要国家关于法定继承人顺序规定的比较分析。第一节对亲等继承制度和亲系继承制度进行比较分析,得出不同具体做法的优缺点。第二节列举英美法系主要国家关于法定继承人顺序的规定。第三节列举大陆法系主要国家关于法定继承人顺序的规定。第四节对配偶、父母、子女、兄弟姐妹、祖父母等的继承顺序进行比较分析,最后得出结论。第三章是关于我国现行法定继承人顺序制度的现状与评析。第一节对我国各种享有继承权的继承人进行介绍和分析。第二节对目前法学界存在的几个热门问题进行了论述并提出自己的观点。第四章是对完善我国法定继承人顺序制度的建议。第一节提出了法定继承人顺序的具体方案,第二节论述了具体理由。更多还原

【Abstract】 The system of property inheritance is an important part of our civil law. With the passage of the real right law, the civil codes will be passed soon. And the inheritance regulation with further amended and improved will be a section of it. Legal succession system occupies the absolute predominance in the field of inheriting. The order of legal heirs is an important component of the legal succession system, and their design will influent people’s vital interests. The author tries to discuss of the order of legal heirs in our country and put some personal ideas about it. In addition, the author offers the legislative proposal and hopes that it will work as something worthy to the legislative body.This article can be divided into three chapters except for preface and conclusion.The comments are as follows:The first part: summary. Give an introduction of the concept and features of the order of legal heirs. Section two is about the factors which can affect the order of legal heirs. Except for production capability, influence factors are traditional customs、religious、socia、moral values and legislative policy. Now, most countries decide the order of legal heirs according to blood relations、marital relations and maintenance relationship.The second part introduces the order of legal heirs in most countries which are be divided into British and American legal system and Mainland legal system. The first section describes relatives. Section two and three are about specific rules of order of legal heirs in our word. Section four is about the conclusions.The third part is on the present situation and analysis of the order of legal heirs system in China. First section introduces all kinds of people who enjois the right of inheritance. Section two introduces some question and put forward my view.The fourth part: suggestions.
