【摘要】 改革开放以来,我国城镇国有土地使用制度改革不断取得进展,但农村集体建设用地流转制度改革却一直徘徊不前。农村集体建设用地流转制度的完善,直接关系到农民、农业、农村的稳定和繁荣,关系到国民经济和社会的可持续发展。因此,研究和规范集体建设用地流转,具有极其重要的意义。虽然目前立法上对农村集体土地使用权流转尚采取严格限制态度,但我国各个试点城市的成功经验充分表明,农村集体建设用地使用权的流转是可行的,其必将对我国深化土地使用制度改革产生积极的影响。本文主体共分三部分:第一部分首先分析了集体建设用地流转的历史沿革,通过对我国集体建设用地使用权流转现状的分析,揭示了集体建设用地流转中存在的主要问题,指出了现行法律规定与流转实践之间的矛盾之处。第二部分阐述了农村集体建设用地使用权流转的基本概念,对“农村集体建设用地”、“土地流转”、“集体建设用地使用权”三概念的含义、特点、范围等进行了界定,并在此基础上揭示出“集体建设用地使用权流转”的内涵。从可能性和必要性两方面对现行土地流转制度的改革进行了分析,指出允许集体建设用地使用权流转符合市场经济发展的规律。第三部分对如何完善集体建设用地流转制度进行了设想。在总结各地实践经验的基础上提出了集体建设用地流转的制度设计方案和发展、完善农村集体建设用地流转的具体对策措施,提出了修改和完善集体建设用地使用权流转的立法建议。更多还原

【Abstract】 Since the reform and opening up, great progresses have been made in the state owned land system in urban, but little have been in the collective owned land circulation system in suburban. The system of collective land circulation is concerned with the tranquilization and prosperity of farmers, agriculture and countryside, and attaches great importance with the sustainable development of national economy and society. Hence, it is urgent to research and regulate collective land circulation. The successful experience in several testing city validates both the necessity and feasibility of the circulation of the rights of exploiting collective land, which will produce a positive effluence on deepening the land exploitation system reform.Based on field investigation and a great amount of documents, the thesis carries through a thorough research on the circulation of the rights of exploiting suburban collective land. This thesis falls into four parts, each of which is given a summary about their contents as follows.The first part analyzes the existing problem and causation of circulation of the rights of exploiting collective construction land. Through the analysis on the status in quo of circulation of rights of collective construction, the chief problem existed are delineated。The second part employs as its grounding an introduction to the basic situation of the circulation of the rights of exploiting suburban collective. It firstly defines several aspects of the three concepts of“suburban collective construction land”,“land circulation”,“the rights of exploiting collective construction land”such as the meanings, qualities and extension.The last case study points out that the circulation of rights of exploiting collective construction land follows the rules of market economy development based on the analysis on its feasibility and necessity.Part three explores the means of consummating circulation of the rights of exploiting collective construction land. Schemes and countermeasures of consummating and developing the system of circulation of the rights of exploiting collective construction land are brought forward on the summary of experience at home and abroad.更多还原
