【摘要】 今年4月,我国新修改的《国家赔偿法》首次将精神损害赔偿纳入到国家赔偿的范围,这是中国法制化进程中非常重要里程碑。但它将精神赔偿限定于“造成严重后果的精神损害”的情况,一般精神损害仍得不到赔偿、而且造成严重后果精神损害的具体情形不明确、赔偿标准不具体,使公民权利在遭受损害的情况下难以得到全面救济,司法实践中也难以操作。因而,现阶段在国家赔偿法中建立完善的精神损害赔偿制度是必要而可行的。完善的精神损害国家赔偿的范围应该包括因名誉权、荣誉权和人格尊严受损害、生命健康权受侵害、人身自由权被侵犯、心理精神严重受损、姓名权、肖像权、隐私权和其它人格权被严重侵犯而请求的精神损害赔偿等五方面的内容。精神损害国家赔偿的标准应综合考虑三个原则:即财产救济为主、非财产救济为辅的原则;赔偿最高数额限定与赔偿数额适当相结合原则和法官自由裁量权原则。更多还原

【Abstract】 In April, this year, our country new modification of《nation indemnification law》bring into the spirit indemnity to the nation to compensate for the very first time of scope, this is China legalization the count for much milestone in the progress.But it compensates spirit to limit at the circumstance of "result in the spirit of the serious result to injure", the general spirit injures to still can not get indemnification, and result in the serious result spirit injure of concrete situation not explicit, indemnification standard not concrete, make citizen right hard under the sistuation that suffer damage to get to relieve completely, judicatory practice in also hard operation.As a result, currently build up perfect spirit indemnity system in the nation the indemnification the method is necessary and viable.The perfect spirit injure nation indemnification of the scope should include because reputation right, right of honor and personality dignity are be subjected to by damage, life health’s right to violate, Human body freedom the right be infringe upon, mental the spirit severity be damaged, name right, portrait right, privacy right and other personality right be seriously infringe upon but request of spirit indemnity etc. the contents of five aspects.The spirit injures nation indemnification of the standard should synthesize to consider three principles:Namely take property salvage as main of, non- property the salvage is an adjutant principle;The principle compensated the tallest quantity to limit to combine together with real indemnification quantity limit;The judge owns the principle of the right of free judgment.更多还原
