【摘要】 生物科学与技术的发展为人类开辟了一个全新的研究领域——遗传资源。鉴于遗传资源巨大的科学和经济价值,世界各国都对其开发利用给予极大的关注。但是,遗传资源分布的不均衡性导致遗传资源利用竞争激烈。发达国家凭借着科学技术和经济优势,无偿对发展中国家的遗传资源进行开发研究,并迅速将研究成果转化为受到国内知识产权法保护的产品和技术。同时,又尽量将遗传资源排除在知识产权法保护的范围以外,从而垄断遗传资源的开发利用并获得巨大的经济利益。发达国家的这种“生物海盗”行为侵犯了发展中国家对于遗传资源享有和利用的权利。因此,研究遗传资源知识产权法保护具有重要的现实意义。本文从遗传资源知识产权法保护问题的基础理论出发,阐述关于遗传资源的概念、特征,并对遗传资源权利归属的种种观点进行探讨；从遗传资源知识产权法保护的理论依据和保护方式等方面分析了遗传资源知识产权法保护的可行性,论证了遗传资源知识产权法保护的正当性；考察了保护遗传资源的国际公约及国外的立法和实践,指出了我国遗传资源保护存在的问题。通过分析我国遗传资源的法律保护现状,从权利取得、权利内容、法律保护等方面对我国遗传资源知识产权法保护制度建设提出了建议。更多还原

【Abstract】 Developments of biological science and technology open up a new research field for mankind --- genetic resources, Due to the view of the huge genetic resources of scientific and economic value, their development and utilization of the world have paid great attention. However, the uneven distribution of genetic resources, the use of genetic resources led to competition. With its highly developed technological and economic advantages, free of charge to developing countries for development of genetic resources, and quickly research results into products by domestic intellectual property protection and technology. The same time, as far as possible out of the resources outside the scope of intellectual property protection, thus dominating the development and utilization of genetic resources and huge economic benefits. Developed countries, this "bio-piracy" behavior infringe the right of possession and utilization for developing countries. Therefore, the protection of genetic resources and intellectual property law has important practical significance. In this paper, it stating from basic theories of property protection of genetic resources, elaborated on the concept of genetic resources and characteristics, talk about the views of the ownership of genetic resources. Protection of genetic resources from the theoretical basis of intellectual property law and the protection of their ways of analysis of the feasibility of intellectual property protection of genetic resources, genetic resources, demonstrated the legitimacy of the protection of intellectual property law. Study abroad, international conventions and legislative practice of protection of genetic resources, and pointed out the problems of protection genetic resources in our country. Through analysis of the status of the legal protection of genetic resources, from the right to acquire, the right content, the legal protection of genetic resources in China in terms of intellectual property protection system construction proposed.更多还原
