【摘要】 随着世界经济全球化进程的加快,国际贸易不断扩张,环境与贸易的冲突日益显现。国际贸易自由化制度和规则可以从多方面直接或间接影响环境,近年来不断出现的由国际贸易引发的环境争议基本都具体引用了WTO框架下的绿色条款。因此,研究这些绿色条款,为识别贸易保护手段,积极应对绿色壁垒,为达到国际标准而努力创新,提升本国企业竞争力都有着重要的意义。本文首先从WTO多边贸易体制下的绿色条款的产生背景开始分析,介绍了环境与贸易的关系,以及贸易与环境谈判的发展趋势。其次重点分析了WTO的主要绿色条款,并结合经典案例分析了WTO争端解决机构对这些条款的具体条文的解释,以便以后我国遇到类似案件具有预测力。最后,本文结合我国环境立法的具体现状,结合前文对WTO绿色条款的分析,对我国与贸易相关的环境立法提出了几点立法建议。更多还原

【Abstract】 Under the trend of economic globalization, the expansion of international trade, environment and trade become more and more conflict. In many ways, the liberalist system and rules of international trade, directly or indirectly, affects the environment. In recent years, some international trade disputes which caused by the basic environment cited the WTO Provisions under the framework of the green provisions. Therefore, in order to identify measures of trade protection, actively respond to the green barriers, the efforts of innovation to meet international standards, and enhance the competitiveness of domestic enterprises, the research of these green provisions are of great significance. In this paper, firstly, described the background of the green provisions that under the WTO multilateral trading system, analyzed the relationship between environment and trade, and the trend of a new round of negotiations. Secondly, the author analyzed the main WTO green provisions, combined with the classic cases analyzed the interpretation of WTO Dispute Settlement Body made. so that China can have predictive power if experience of similar cases. Finally, this paper combined with the specific circumstances of environmental legislation in our country, in light of the foregoing provisions of the WTO Green, raised a number of legislative proposals of China’s trade-related environmental legislation更多还原
