【摘要】 本文以《意见》为背景,分析了其中规定的新类型受贿犯罪及认定中的疑难点。受贿案件一直是反腐败的重点,但随着经济社会的不断进步,各种新形式的受贿犯罪层出不穷,实务界对各种新形式的受贿行为罪与非罪意见不一。《意见》的出台无异于一场甘霖,但其中的细节问题却引起广泛的争论。本文旨在对《意见》中的各种新类型犯罪的认定提出相应的观点,以期对新类型受贿的认定尽绵薄之力。全文包括引言、正文、结语。其中正文第一、二章主要是对交易型受贿、干股分红型受贿、合作投资型受贿、委托理财型受贿、赌博型受贿、“挂名”领薪型受贿、特定关系人收受型受贿、离职后型受贿等新类型的受贿行为的认定及其疑难点作了认真的分析与探讨。第三章主要是对收受贿赂物品未办理权属变更问题与关于收受财物后退还或者上交问题的探讨。更多还原

【Abstract】 This paper is based on the Notice of the Supreme People’s Court and the Supreme People’s Procuratorate on Printing and Issuing the Opinions on Issues concerning the Application of Law in the Handling of Criminal Cases Involving the Acceptance of Bribes, which analyze the difficulties and complicated cases of new type bribery and their affirmation listed on this notice. The bribery has always been the main target of anti-corruption. With the development of economy and society, various bribery emerge one after another, yet the executives disagree with each other on the identification of being guilty or not. The notice’s emergence was on the right time, however, some of the details have rose controversy. This paper is aim at proposing some ideas on the identification of various new type bribery.This paper is consists of preface, text, summary. Chapter one and chapter two are mainly on the deeply analysis and discussion of the identification and their difficulties of various new type bribery such as: Accepting bribery through obtaining margins during commercial transactions; Accepting bribery through receiving the corporate shares without payment of consideration; Accepting bribery in the name of cooperative investment; Accepting bribery in the name of entrust financing; Accepting bribery through gambling; Accepting bribery after leaving positions; Accepting bribery through the specific concerned person(s). Chapter three mainly analyzes the issue of accepting bribes without registration or returning or turning in the property received.更多还原
