论我国夫妻财产制的完善

【摘要】 夫妻财产制又称婚姻财产制,是规定夫妻之间财产关系的法律制度,它是婚姻家庭制度中极为重要的法律制度。从家庭内部来讲,夫妻财产制规范着婚姻当事人各方对婚姻和家庭的法律责任,保障着家庭中弱势方的权益,并促进家庭的稳定和睦。从社会角度来看,夫妻财产制的设置直接关系着民事交易安全,受到各国和地区婚姻立法的普遍重视。建国以来,随着社会和经济的发展,我国夫妻财产立法经历了从一般共同制到婚后所得共同制为主、约定财产制为辅的夫妻财产制,再发展到现行的以夫妻共同财产制、个人特有财产制和约定财产制为一体的立法过程,从而最大限度地体现了男女平等、个人财产所有权的公平以及对弱势群体的保护原则。然而在私有经济等多种经济迅速发展的今天,夫妻财产的内容和形式都有了较大的变化,呈现出多样化、复杂化趋势。本文在夫妻财产制的类型、法律特征与历史沿革,不同法系国家间夫妻财产制的立法考察、比较与分析等一些相关理论的基础上阐述个人的理解和认识,并针对现实存在的问题,从理论与实践相结合的角度出发,着力把握夫妻财产制的本质需求,尽力客观思考和理性分析,谈一些自己对夫妻财产制完善的意见和建议。更多还原

【Abstract】 Matrimonial property system, also known as marriage property system ,is the legal system of property between husband and wife, it is the extremely important legal system in marriage and family system. From the family, Matrimonial property system is to rule each of the couple’s the marriage and the family’s legal responsibility, to protect the family’s rights and interests of the disadvantaged and to promote family harmony and stability. From the social point of view, the set of the matrimonial property system is to set up a direct bearing on the civil security transactions, subject to various countries and regions in the universal importance of marriage legislation. Since 1949, with the social and economic development, China has gone through marital property legislation from the general common-income married to the co-main system, supplemented by an agreement of the husband and wife property system and property system should be further developed to the present to the couple’s common property system , Personal property and unique property of agreed system for the whole of the legislative process so as to maximize to reflect the equality of men and women and the individual ownership of property, as well as the fairness of the principle of the protection of vulnerable groups. However, today with the private economy and other fast-growing economy, the meanings and the forms of the couple’s property have greatly changed , showing diversity and complexity of the trend. In this paper, the type of marital property, legal and historical characteristics and personal understanding and awareness on the basis of different national legal systems of property between husband and wife legislative study ,comparison with and analysis on other related theories , the views and suggestions on improving the matrimonial property system are given for real problems, from the theory and practice point of view, by grasping the nature of marital property system needs with the method by making every effort to objective thinking, rational analysis.更多还原
