【摘要】 随着经济的快速发展,我国知识产权事业也得到长足的发展,知识产权以越来越大的比重成为人们的财产内容。离婚时对知识产权的分割往往会成为夫妻财产分割的焦点,因为知识产权能够给当事人带来极大的利益空间,如知识产权的所有人可以将知识产权的财产权全部或者部分转让给受让人,从而获得转让费;还可通过许可他人使用,从而获得授权许可使费用等等。然而,作为一种不同于传统财产的特殊权利,知识产权有着自身的许多特殊性,这些特殊性加之我国现有的夫妻财产分割制度存在的不足之处,使得离婚时双方对知识产权的归属存在着许多的不同观点与争议！也正是这些问题的存在,使得当事人各方难以充分有效地维护自己的权益,也使得在离婚时知识产权的分割难以实现实质意义上的真正平等。本文的讨论正是基于这些问题。本文除前言和结语外,分为以下三章论述:第一章主要分析知识产权不同于一般财产的特殊性,接着进一步分析其特殊性对夫妻财产分割的特殊影响。第二章就我国夫妻财产制度对知识产权分割的影响进行阐述。先从我国现行法律对离婚时夫妻知识产权财产分割的相关规定入手,接着分析我国现有的夫妻财产制度的相关规定。最后,综合学者们的观点对法律关于离婚时夫妻知识产权财产分割的规定进行评析。第三章试图在综合分析前两章以及学习、借鉴其他学者的研究基础上对离婚时知识产权分割机制提出构想。先分析离婚时知识产权分割机制设立的价值取向问题;接着分析分割的原则及措施;最后,根据不同类型的知识产权在各自特征上存在的差异而尝试对几种不同类型的知识产权提出相应的特殊分割措施,主要就传统的著作权、专利权和商标权展开论述。更多还原

【Abstract】 As the economy grows rapidly,the undertaking of intellectual property has made great progress.The intellectual property has become one important part of property of the Chinese people.When it comes to a divorce,the property division will become an important issue because the intellectual property brings benefits to its owner.For example,the owner of the intellectual property can transfer all or the part of property right to others to get the transfer fee.He can also charge others by authorizing them to use the intellectual property.However,the intellectual property is a kind of special property different from the traditional property.Because of the special features of the intellectual property and the defects existing in the divorce settlement regulations of the Chinese marriage law,there are a lot of arguments and different opinions on the division of the marital property.Those problems have made it difficult for the spouses to safeguard their rights and ensure the real equality in the divorce settlement.The arguments of the article are based on the solutions of these problems.There are three chapters in this article except the foreword and the conclusion:In the first chapter the author mainly analyzes the special features of intellectual property which is different from other kinds of property.Further,she discusses the influences of the special features on the division of the property of a married couple in a divorceIn the second chapter the author discusses the influence of the Chinese property law for a married couple on the property division in a divorce.The author analyzes the current regulations for the division of the intellectual property in a divorce and the law related to the property owned by a married couple.Finally,the author makes comments on the division of intellectual property in a divorce by referring to some scholars’ opinions.Based on the analysis of the first and second chapter and the achievements of other scholars,the third chapter brings some ideas on the division of intellectual property in a divorce.Firstly,the author discusses the value orientation of the division of intellectual property in a divorce.Secondly,she analyzes the principles and methods.Finally,she puts forwards some special dividing methods for several kinds of intellectual property based on their characteristics.The three traditional forms of intellectual property-copyright,patents and trademark-are discussed in details.更多还原
