【摘要】 法律文化是法制现代化过程中的决定性因素,法制现代化实际上就是对社会上存在着的法律文化资源的重新选择的过程。法律文化与法制现代化之间的联结点来自于法律文化对法律制度的社会性功能,它塑造着一种普遍的社会精神,从而对附着在社会特征上的法律制度的演进和发展发挥主导性、支配性的影响。法律文化对法制现代化的功能就体现在它的主动性观念和支配性风格,这一功能发挥的程度也随着法律文化的不同而不同,既可以对法制现代化起抵制、扰乱或阻碍作用,也可以对法制现代化起支持、调适和巩固作用。在不同的国家交往中,它们的法律文化进行着碰撞和冲击。当其中一个国家的法律文化遭到异质文化的冲击时,二者便产生了冲突和变化。而异质文化只是引起这种变化的一个外因,其真正的原因还在于本民族(国家)内部已存在着大量的矛盾和诸多不合时宜的东西。当代,依法治国的关键是正确处理好三种法律文化。即西方法律文化,中国传统的法律文化和马克思主义的法律文化,这三种历时性的法律文化以共时性的形态存在于今天的人们意识形态中,使我国的法制现代化既有时间跨越又有空间的跨度。要使这三种异质的法律文化都能为我国市场经济服务,即必须建设现代多元的社会主义法律文化。建设现代多元的社会主义法律文化,关键和难点就在于文化的融合。在这个融合的过程中,既要保留各种文化固有的特色和精髓,更要让它们在冲突和融合中形成新的有中国特色的社会主义法律文化,并在中国未来的发展中保持健康、合格、协调,推动我国法制现代化的发展。更多还原

【Abstract】 The legal culture is determining factor in the legal system modernization process, the legal system modernization in fact is the society legal culture resources again choiced process. Junction point between the legal culture and the legal system modernization comes from the function that legal culture to the social legal regime. It is molding one kind of universal social spirits that leading the dominant influence to the legal regime evolution and development display sticking cohere in the social characteristic .The main infection of legal culture to the legal system modernization function is its initiative idea and the dominant style and this function display degree also along with legal culture difference , which may to legal system modernization resisting, the harassment or the hindrance function, also may to the legal system modernization support, the adjustment and the consolidated function.In the different national contact, their legal culture is carrying on the collision and the impact. When national legal culture encounters the impact of the heterogenous culture, the two will have the conflict and the change. But the heterogenous culture only external factor that causes this kind of change, its true reason lies in this nationa (country) internal which have the massive contradictions and many inopportune things. The present age, the key of rules the nation legally is to manage the three kind of legal culture correctly. Namely Western law culture, Chinese tradition legal culture and Marxism legal culture, these three kind of diachronic legal culture all exists in the ideology of today people leading our country’s legal system modernization both to have the time to surmount and has the spatial span. If these three kinds of the interagency legal culture all to serve for our country market economy, we must construct the modern multi-dimensional socialism law culture.The key and the difficulty of the modern multi-dimensional socialism law culture construction lie in the culture amalgamation. In this fusion process, must retain each cultural inherent characteristic and the essence, must let them forms newly in the conflict and the fusion has the Chinese characteristic socialism law culture, and will maintain healthily qualified and coordinated in the Chinese future development, and impels the development of our country legal system modernization更多还原
