【摘要】 法的功能问题,是法学理论和法律实践中具有实际意义的重大主题,需要法学学人作系统和深入的研究。但无论中国学界或是我们已注意到的国外学界,关于这个主题的研究还不够深入。实际生活的运行需要有清晰而科学的理论来解说法的功能问题,来支撑和引导法的功能同实际生活的妥善结合。一方面,法的功能不等于法的作用或法的价值及法的目的等概念,它们具有本质上的不同,不可混淆使用。法的功能的特殊属性在于它是法本身所固有的、客观的、稳定的、应然的、可能的属性。另一方面,研究法的功能的意义就在于使法的功能在我国得以充分实现。而法的功能的实现需要具备若干个条件,包括法的功能实现的内在要件与外在要件。法的功能实现的内在要件又分为内在内容要件与内在形式要件。其中,民主、法治、公平正义要素基本构成了法的功能实现的内在内容要件;词语准确性、结构合理性、体系系统性则构成了法的功能实现的内在形式要件。法的功能实现的外在要件就是在司法、执法、守法过程中应当具备的影响法的功能实现的具体构成要素。分析问题的目的就是为了解决问题。研究法的功能的实现的实践意义就是为使法的功能在我国得以充分实现。在分析法的功能在中国的实现问题时,必须首先着力分析目前法的功能在中国实现过程中所遇到的障碍。这些障碍有些是法的自身属性带来的,即先天性障碍,如法的非全真性、非周延性、不确定性、僵硬性等障碍;有些是后天制度运行所带来的障碍,如立法、司法、执法、守法原因导致的功能实现障碍。针对中国社会实践的客观情况,实事求是,尽力排除这些障碍的干扰,尤其是后天制度性障碍带来的干扰,探求法的功能在中国得以充分实现的途径,以期能够为和谐中国的法制建设有所益处。更多还原

【Abstract】 The function of law which needs law scholars to do systematic and in-depth research is the legal doctrine and practice with the major theme of practical significance. But whether we are in China or our foreign scholars on the theme of this study is not enough. The operation of life and the scientific theory of the function of law require having a clear theory to support and guide the function of law with the proper combination of real life. On one hand, the function of law does not mean that the role of law or the law of value and the purpose of such concepts, they are fundamentally different from each other that can not be used to confuse. Special attributes of the function is that it is inherent in the law itself, the objective, stable, and should be a matter of the possible attributes. On the other hand, research on the function of the significance of the function of law is to be fully realized in China. But realization of the law function needs to meet certain requirements, which including the inherent elements and external elements of realization of the law function. The inherent elements of implementation of law function are divided into internal content elements and internal form elements. Among them, democracy, the rule of law, fairness and justice constitute the basic elements of the inherent content elements of realization of the law function; Words accuracy, rational structure and the systemic system constitute the inherent form elements of the realization of law function. The external elements of the implementation of law functions are the specific elements which should have realized in the administration of justice, law enforcement, law-abiding. The purpose of the issue is to solve problems. So the practical significance of the study on the implementation of law functions is to make the law functions in our country can be fully realized. In the analysis of the realization of law functions in China, we must first focus on the functional analysis of the current law in the process of China’s realization of obstacles. Some of these barriers are the attributes of its own, which is congenital obstacles, such as all of the non-genuine, non-complete, uncertainty, rigidity; some of the obstacles are brought by operating system, such as legislative, judicial, law-enforcement and law-abiding reasons. Against the objective of China’s social practice, seeking truth from facts, to remove these obstacles interference, especially remove these interference acquired by institutional obstacles,to explore the way of the realization of law functions in China to fully realized ,and I hope it is better to the harmonious development of legal system in China .更多还原
