【摘要】 高校学生教育管理的秩序化和法治化研究,是高校思想政治教育研究的新领域,是体现思想政治教育研究水平的标志之一。关心学生、尊重学生和保障学生的合法权利,是高校学生思想政治教育中法制教育研究的重要内容。高校学生处分制度,是高校学生管理制度的重要组成部分,学生处分原则、种类、程序的不断完善,是高校学生管理制度完善的基本要求。高校学生教育管理秩序化和法治化是高校管理人、教育人、培养人的终极价值实现的必然要求,高校学生处分制度是一项系统而又复杂的工程,不是一朝一夕就能够完成的,还需要进一步深化理论成果,在实践中更好的尊重和保障学生权利,实现高等教育的目的。依托教育规律和教育法制理论,通过规范分析、实证分析、比较研究等方法,评析和界定高校学生处分的有关理论,阐释和分析我国古代太学的学生管理体制以及域外高校学生处分制度,剖析和探究我国高校学生处分制度的现状,构建和完善我国高校学生处分制度,推动处分制度在高校的教育管理实践中不断发展和完善。高校学生处分,是高等学校在法律法规授权下对有违法、违规、违纪行为的学生给予批评教育或者纪律处分;因高校与学生之间兼有民事法律关系和行政法律关系,高校做出的学生处分行为是具有行政处罚性质的教育管理行为;剖析我国现行处分制度,归纳我国古代太学教育管理体制和当今域外高校学生处分制度,在借鉴先进、合理的处分制度基础上构建和完善我国高校学生处分制度,对处分原则、处分程序以及学生权利救济方式和高校侵权责任承担等提出建议,希望建立学生校内法律援助制度等,以期对高校学生思想政治教育工作的开展起到一定的作用。更多还原

【Abstract】 The increasing consummation in students’punishment of the principle, the type, the procedure, should have the topic in the universities control system consummation. The system of universities students punishment, is essential part of the universities control system。The research in order and law in education administration of universities student, is the new domain of ideological and political education research, which manifests the level of ideological and political education research。The respecting student and keep student’s law rights is one of the main contents in the universities student ideological and political education .Presently, while "the 16th document" and "Management Regulation of Ordinary College Students”appears one after another, various universities drew up new stipulation to manage student. It caused the positive result in the system of student punishment of our country theoretically and practically and stepped the new stair in punishing students。However, the order and law of the universities student education administration is an inevitable request in the universities supervisors, educating the person, raising person’s ultimate value realization, this cannot achieve fast, also needs further to deepen the theory achievement to respect and safeguard the student right by the time in the practice and realize the goal of higher education。This article depends on the laws of education and the theory of education legal system, through the methods of standard analysis, real diagnosis analysis, comparison research and so on, evaluates and limits the related theory of universities student punishment, analyzes and inquires the present situation of the system of student punishment in our country, constructs and consummates the system of student punishment of our country, impetus punishment system increasingly development and consummation in university’s education administration practice.First, this article limits the concept of university’s student punishment which punishes the universities student for the college under the legal laws and regulation authorization to illegal, contrary, indiscipline students and imposes the education through criticism or the disciplinary action.Secondly, analysis legal relationship between the universities and students, proposed the universities and the student having the civil legal relations and the administrative legal relations, and thought it’s education administration behavior which the universities decide the punishment. Thirds, conducts the research to our present punishment system , analysis and introducts ancient Imperial College education administration system and now outside universities student punishment system.Finally on the basics of modeling advanced and reasonable punishment system, constructs and consummates our country universities student punishment system, put forward the proposal to principle in punishment, flow in punishment as well as the student right redress way and the universities right infringement responsibility undertaken and so on. This article carried on some explorations in the system of student punishment of our universities student, proposed some perfect suggestions, in order to defend and safeguard universities student’s legitimate rights and interests, promoting the order and law of universities student education administration to play certain role in the development of universities student ideological and political education.更多还原
