【摘要】 本论文对我国信访制度存在问题及对策进行了深刻的探索。论文第一部分探讨了我国信访制度的状况并对这一问题研究的思路和方法进行了较为详细的阐述。第二部分是我国信访制度的演变发展,该部分追溯了信访制度的历史渊源,重点介绍了我国古代的直诉制度,对新中国成立后至改革开放和改革开放以后两个时期信访制度的确立发展从时间划分上进行了详细论述,为信访制度的进一步研究做铺垫。第三部分是信访制度存在的问题及成因,该部分从信访量、信访涉及面、信访秩序、信访形式等四个方面分析了我国信访制度存在的问题,并从内因和外因两个角度对造成这些问题的原因进行了分析。第四部分是信访制度改革的对策研究,提出了信访制度改革要坚持法治原则、信访公开、公正及效率原则、信访机构相对中立性原则、信访机构相对中立性原则、渐进主义原则,并从建立健全各级党委和政府的信访责任制,实行绩效管理;加强信访制度建设的法制化进程;整合各种社会矛盾调处机构,规范信访部门职能权力;畅通信访渠道,实行阳光信访等四个方面提出改进的措施。更多还原

【Abstract】 Having a glorious historical origin and social basis, the `letter and visit’ institution, as a political role by which the citizen participate in politics and the public express their opinion; has played an important part in history. But since the reform and open, with the increasing contradictory and the unceasing enhancement of citizens rights consciousness brought by sudden social transition, the present `letter and visit’ institution has proved not to have the ability to find solutions to many problems and it is not consistent with the development request when it is faced with multitudinous contradiction and high expectations. It meets unprecedented crisis and awkward. As a result, the government rapidly gets hands on the revision work for `Regulations on Letter and Visit’. It tries to solute serious problems caused by the `letter and visit’ institution through attempt to adjust and improve it. And the implementation of the new `Regulations on Letter and Visit’, is only the first step with which `letter and visit’ institution innovation begins. If we want to find an ultimate solution to the `letter and visit’ institution, we must analyze the question which the new rule has not solved, and seek the solution outlet according to the characteristics in the transition period. The `letter and visit’ institution has gong to an institution innovational pass and the `letter and visit’ institution innovation is imperative.This article set about the history of china’s `letter and visit’ institution, and analyzes the problems and its reasons of the china’s `letter and visit’ institution in new period. This article thoroughly discussed the realistic circumstance of the china’s `letter and visit’ institution. With the domestic and foreign experience, this thesis proposes the innovational conception of `letter and visit’ institution in new period. This article is composed of four parts: The first part is exordium, which put forward the question and the method of the research to propose the foundation for the next part of this article. It inducts the present situation of `letter and. visit’ institution which the domestic scholar has researched; The second part mainly talks of the `letter and visit’ institution’s origin and its development. This part traces back to the history of china’s `letter and visit’ institution, and mainly pays special attention to the development and evolution of the present institution in order to offer the foreshadowing to the further research of the institution of `letter and visit’; The third part is the realistic questions and reason of China’s `letter and visit’ institution. In this part, the article analyzes the `letter and visit’ institution from the amount and order and form of `letter and visit’ institution, and it sums up the internal and explicit reasons of the `letter and visit’ institution in new period; The fourth part is the innovation tentative plan of China’s `letter and visit’ institution in new period. In this part, the article first analyzes the the innovation circumstance of `letter and visit’ institution innovation, then this part introduced the typical pattern of `letter and visit’ institution innovation, And according to the present environment of the `letter and visit’ institution ,the article proposed the innovational conception of `letter and visit’ institution in new period.更多还原
