【摘要】 继承法律制度由法定继承、遗嘱继承和遗产的处理共同组成。其中遗产的处理主要涉及分割遗产的一些程序性规定。本文主要通过对世界上主要法系国家法律与我国法律的继承人范围及顺序和代位继承,特留份和信托遗嘱,遗赠和继承程序的规定进行比较,提出自己对完善继承法律的一些粗浅的见解。(全文共32994个字)本文开篇部分是简短的序言,序言之后,就是正文,最后是简短的结语,正文由五部分组成。第一部分是概述,主要是简要介绍英、德、法、美国家的法定继承、遗嘱继承及继承制度的历史沿革。第二部分是法定继承。比较世界上主要法系国家与我国法律对法定继承中的继承人范围、顺序和代位继承的规定,分析我国继承人范围、顺序和代位继承中存在的问题。第三部分是特留份和信托遗嘱。详细介绍世界上主要法系国家与我国法律对特留份、信托遗嘱制度的规定,通过比较指出各国立法的可取之处以及我国立法有待完善的地方。第四部分是遗赠和继承程序。首先介绍英美法系和大陆法系的国家和地区有关遗赠和继承程序的规定,然后介绍我国法律关于这二项制度的规定,最后,通过比较,指出我国在遗赠和继承程序上存在的问题。第五部分是完善意见。通过前述四部分的分析,提出我国法定继承(继承人范围、顺序,代位继承),特留份和信托遗嘱,遗赠和继承程序的完善意见。更多还原

【Abstract】 Succession law systems are composed of legal succession, testate succession and inheritance processing. Inheritance procession mainly touches on some procedural provisions concerning inheritance distribution, the part is taken as single chapter, namely succession procedure in this thesis, Making a comparision between main legal system country’s law and china’s law regarding the following provisions, namely the scope and order of the heir in legal succession and succession by subrogation, the Necessary Portion of Inheritance Testate succession and Will Trust Bequest , the Bequest and Succession Procedure Succession . This thesis/article will advance some simple views for succession legislation in china. (the full text are 34899 words).The beginning of the article is brief preclude and the following part is the main body of the article.the final part is brief concluding remarks, the article is composed of five parts.The first part is the outlines of inheritance succession , mainly make simple introduction about legal / statutory succession in England ,Germany ,France and the United State, and the history of Succession system.The second part is the system of statutory succession. Comparing the main law system country’s law with the china’s law about the provisions of the scope and order of the heir and succession by subrogation in statutory succession,analyse the problem in the scope and order of the heir, and succession by subrogation in china.The third part is the necessary portion of inheritance testate succession and will trust. Make detailed introduction on the following systems of main law system corntry’s law in the word and the china’s law, the Necessary Portion of Inheritance Testate succession and Will Trust. Point out the merits of each country’s legislation and the parts needed further improvement in china’s legislation by the above comparision.The fourth part is Bequest and Succession Procedure.At first , make a introduction on the involved provisions in Anglo-American law system and continental legal system , and make a introduction about the provision in it in china . finally,By comparision, point out the problem in Bequest and Succession Procedure in china.The fifth part is improvement opinion , By the above 4 Part’s analysis ,advance some improvement opinion concerning statutory succession ( scope and order of the heir ,succession by subrogation), the Necessary Portion of Inheritance Testate succession and Will Trust Bequest , Bequest and Succession Procedure.更多还原
