【摘要】 中国改革起步于农村,而农村改革始于土地制度改革,自1978年底开始的农村土地制度改革,在经历了二十多年的历史性变迁后,确定了农村土地集体所有、家庭经营的基本框架,并在此基础上发展了多种形态的土地使用制度,农村土地产权制度的变迁成功地推进了农业的增长和农村经济的繁荣。今年是农村改革30周年,而安徽又是农村改革的发源地,因此选择这个课题进行研究对农村土地产权制度的研究具有重要的意义。本文着重对建国后安徽农村土地制度的演变、进行概括性梳理。农村产权制度变迁进行研究,这对指导安徽乃至中国未来农村土地制度的创新无疑具有重要的指导意义,对目前农村土地制度改革创新方向具有极大的启发和帮助。本文对农村土地产权制度的研究以安徽省为例,着重利用制度经济学的相关理论,采用实证分析和理论分析相结合的方式对这一问题进行研究,本文主要分为五个部分。第一部分为引言,主要对文章的目的及意义,本文所采用的研究方法内容,技术路线,理论创新与不足进行阐述。第二部分为对本文涉及到的相关理论进行解释,为下文研究做铺垫。第三部分为本文的核心部分,主要从理论层次对农村土地产权制度变迁进行分析,首先回顾农村土地产权制度变迁的阶段,然后对每个历史阶段进行理论评述,总结现阶段土地产权制度的缺陷性,及对改革土地产权制度的启示。第四部分主要利用数据对本文进行分析。主要从以下三个方面进行分析:一是影响土地制度变迁的因素,包括剩余劳动力转移、土地保障职能、制度环境方面。二是农村产权制度的贡献性分析。三是农村产权制度的认知分析,包括对现行的土地产权制度的现状和农地改革方案的认知。第五部分为本文的结论部分,首先探讨农村产权制度改革的思路,然后探讨农村土地产权制度改革的对策。通过分析本文的观点如下:寻求什么样的农村土地产权制度关键是看此制度能否带动广大农民的生产积极性和创造性。如能带动生产积极性,就能够促进农业生产力的发展,否则就将阻碍其发展。农村土地产权制度改革的关键在于明晰土地产权,使农民真正意义上拥有土地的产权。本文在研究过程中理论创新较少,可能的创新之处在于通过对农村土地产权制度变迁的过程进行回顾,然后利用制度经济学的相关理论和调查数据对农村土地产权制度变迁进行分析,总结现阶段农村土地产权制度的缺陷,提出解决此问题的相关思路和建议,对农村土地制度的改革具有一定的意义。更多还原

【Abstract】 China’s reforms initiated from the rural areas, and more precisely from land system reform, since 1978 more than 20 years land tenure system reform has set up a basic institutional framework of collective ownership and household management and the developed different pattern of land utilization system. System of land using based on this and the changing of the rural land property rights successfully advanced the agricultural growth and prosperous of rural economyThis year is the rural reform 30th anniversary, but An hui is also the rural reform place of the origin, therefore choosing this topic to conduct the study which has the important significance to the rural land property rights.This article emphatically analyses evolution of An hui the rural land property rights after founding nation, carries on the concise quality to comb.A study on changes of rural land property rights has the important guiding sense without doubt in the future, which instructs rural land property changing of An hui province and even China the rural land system’s innovation will have the enormous inspiration and help to the innovational direction of present rural land property.This article takes An hui Province as an example and emphatically use theories of the new institutional economics, selecting the method which the empirical analysis and the theoretical analysis unify to this question to conduct the research, this article mainly divides into five parts.The first part is an introduction, it importantly introduce the article goal as well as the significance, research technique content which this article uses, the technical route, innovational and insufficient places.The second part, which explants the related theory which involves to this article, the following research bases on it.The third part is the core of this article, it mainly analyzes on the rural land property rights, firstly reviews changing of the rural land property rights, comments and narrates each historical stage, lastly summarizes the flaw of the rural land property rights as well as to enlightenment of the rural land property rights.The fourth part mainly carries on the analysis on the article by means of data. It mainly carries on the following three aspects: firstly , the factor which influence land system changing, including surplus-labor shifting, land safeguarding, aspects of system environment ,secondly contribution of the rural land property rights. thirdly cognitional analysis of the rural land property rights, including present land property system’s present situation and cognition of farmland reformThe fifth part is conclusion of this article, firstly it discusses the way that the countryside equity system reform, then discusses the countryside land equity system reform the counter measure.Through analyzing the article, article’s viewpoints are these. Seeking for what rural land property rights is whether this system does lead the general farmer’s enthusiasms of production and the creativity. If it can lead enthusiasms of production, it can promote the productive forces development, otherwise it hinders its development. The key lies in the defined land property right, enables the farmer to have the land property right in the true sense.The theories innovation of this article are few in the research process, places of the possible innovation to lie in through carrying on the review to the process of the rural land property rights changing, then carries on the analyzes it, using the theories of the new institutional economics and the cruising data to the rural land property rights ,summarizes the present stage the flaw of the rural land property rights , proposed related mentality the suggestion which solves these question, it has certain significance to reform of the rural land property rights.更多还原
