信访、选举：村民自治背景下农民利益表达渠道

【摘要】 农民利益表达是政府制定政策、解决问题的前提条件,同时对于农民不满情绪及社会能量来说,畅通的利益表达渠道本身是一种泄洪装置。而现在农民利益表达渠道不畅通与低效,正影响着三农问题的解决与和谐社会的构建。本文通过对东街村定销户事件发生、发展、解决过程的描述,并对该事件中定销户所采用的利益表达渠道——信访、村级选举进行分析,指出信访在农民利益表达方面总体上弊大于利,村级选举在农民利益表达方面的作用也是非常有限的。文章在建议规范信访流程,做好村民自治下的村级组织选举,以完善、拓宽农民常用的利益表达渠道的同时,结合国家政治建设民主取向的背景,还提出增加农民在国家政策制定层面的利益表达、完善新闻媒体舆论监督、规范行政诉讼和行政复议行为等利益表达渠道。更多还原

【Abstract】 The expression of peasantrys’ behalf is the precondition of the policy making and problem solving of our government, meanwhile considering of the discontent of peasantry and their social energy, an expedite channel of the expression of their behalf can be said a set of flood discharge itself. Whereas, the obstructness and low efficiency of the benefit expression of peasants, in present time, has been affecting the solving of the three-dimensional rural issues and the establishment of Harmonious Society.This article describes the occurrence, development and settlement, of the fixed-rationing residents issue arosed in DongJie Village, and analyzes the mechanisms the fixed-rationing residents had used for their benefit expression : Letters and Visits together with the village level election. Through the description and analysis, the article indicates that in aspect of the benefit expression of the peasantry, the shortcomings of Letters and Visits weigh heavier than it’s advantages in general, while the effection Village Level Election can make in this facet is very limited. The author makes the suggestions that it is helpful to regulate the procedure of Letters and Visits, and to develop the village level election well under the villagers’ self-governance, so as to perfecting as well as broadening the peasants’ usual methods of benefit expression. At the same time, considering the background of the democratic orientation of our country’s political construction, the author also puts forward that the peasantry’s benefit expression at the level of national policy making, the perfecting of the supervision of public opinion by news media, the regulation of Administrative Procedure and Reconsideration could be considered as peasantry’s new benefit expression chanels.更多还原
