【摘要】 近几年来,医疗纠纷诉讼案件在我国呈逐年上升的趋势。随着人们对自身权利的日益关注,精神损害赔偿在医疗纠纷中也逐渐成为一个热点问题。并且,由于医疗行为本身的特殊性使医疗纠纷成为一个特殊的民事纠纷,其精神损害赔偿问题也有其特殊性。本文从我国医疗纠纷赔偿制度的角度进行剖析,着重于对精神损害赔偿问题的研究,通过对现阶段状况的分析,指出目前在此问题上面的不足和空缺。并以有关医疗纠纷精神损害赔偿案件进行具体分析,以个人利益、社会利益和公共利益三者的关系为视角,探讨在现行法律规定的框架下解决医疗纠纷的精神损害赔偿中,如何既能考虑医疗行为的特殊性,又维护患方的合法权益,在两者之间达成一种平衡,既保障医疗卫生事业的顺利发展,又使患方的精神损害得以“医疗”。第一部分,介绍精神损害赔偿在医疗纠纷中的特殊性,引入精神损害赔偿的特征和社会功能,说明其制度意义;第二部分,从具体案例着手,着重介绍目前我国医疗纠纷中精神损害赔偿的现状,指出其在立法和司法实践上的不足,特别点名其空白点。第三部分,从立法和司法实践等方面提出建议,以完善我国的医疗纠纷中精神损害赔偿制度。第四部分,以平衡医患利益的关系为视角,通过一经典案例推出用合理的精神赔偿达到医患和谐的重要性。更多还原

【Abstract】 In recent years, the medical dispute case has presented the trend of rising in our country year by year. With people’s concern day by day about one’s own right, the compensation for spiritual damages becomes a hot problem in the medical dispute gradually too. As the medical dispute become a special civil disputation because of one’s own particularity of medical behavior, the question of compensation for spiritual damages has its particularity too.This text dissects in terms of compensation system of medical dispute of our country, focuses on the study on problem of compensation for spiritual damages. Through an analysis of state of the present stage, it points out deficiency and vacancy on this question at present. And it makes a concrete analysis of the case of compensation for spiritual damages of relevant medical disputes. Regarding individual interests, social interests and relation of public interests three as the visual angle, it probes into the compensation for spiritual damages solving the medical dispute under the frame of the current legal provisions, and how to not only can consider the behavioral particularity of medical treatment safeguard, but also suffer from the square legitimate rights and interests to reaches a balance between the two.Part one introduces the particularity in the medical dispute of compensation for spiritual damages, then introduces the characteristic of compensation for spiritual damages and social function, explains its meaning of system.Part two sets about from the concrete case, then introduce the current situation of compensation for spiritual damages in the medical dispute of our country at present emphatically, pointing out its deficiency in legislating and judicial practice, especially call the roll in its gap.Part three regards relation of balanced doctors and patients’ interests as the visual angle, then legislate to put forward the suggestion in respect of practicing with the administration of justice etc, in order to improve the system of compensation for spiritual damages in the medical dispute of our country. Part four to balance the interests of the doctor-patient relationship perspective, through a classic case launched by the spirit of reasonable compensation to doctors and patients of the importance of harmony.更多还原
