【摘要】 随着我国工程造价纠纷的日益增多以及诉讼弊端的日益暴露,对多元化的纠纷解决方式的需求越来越强烈,建立工程造价纠纷的替代性纠纷解决(Alternative Dispute Resolution)机制将成为社会发展的必然。在此机制中,ADR的参与主体以及参与方式是不容回避的重点研究问题。本文较为系统的把ADR引入到建设工程领域中来,并且从我国工程造价咨询企业的角度,研究了开展ADR业务的可行性及进入的路径问题。本文主要运用了对比分析、标杆分析、SWOT分析等方法和工具,从以下几个方面深入解决文章的关键问题:1.在对国内外工程领域中的纠纷解决方式作了系统分析的基础上,引入ADR,并且利用委托代理理论和交易成本理论分析了ADR的先进性和效率的本质;接着,着重研究了ADR的关键成功因素,这些都为我国ADR的机制的建立作了理论铺垫;2.通过借鉴香港的威宁谢和利比两个公司的实践标杆,归纳出了工程造价咨询企业开展ADR业务的两个关键条件,即宏观上政府的法律政策的引导,微观上从业人员素质的提高;利用SWOT工具分析我国工程造价咨询企业开展ADR业务的内外部环境,通过和关键条件的比较论证我国工程造价咨询企业开展ADR业务的可行性。3.在国内外对ADR的研究基础上,归纳出我国工程领域构建ADR机制的三种模式,即法院附设模式、合同文本模式和松散模式。然后,通过对三种模式中主体的身份及素质要求的分析得出,我国工程造价咨询企业中的造价工程师可以通过调解员、DAB、DRB成员等身份参与到ADR中来。接着,从政府政策支持、企业人员和组织的改革等多个角度提出了我国建立ADR机制的条件建议。最后,结合案例探讨了我国工程造价咨询企业开展ADR业务的流程。更多还原

【Abstract】 With the cost engineering disputes increasing and the shortcomings of litigation exposed, the need of the pluralistic dispute resolution method grows more and more strongly. It is necessary to set up ADR mechanism for the cost engineering development. In this mechanism, the body and method of participation for ADR are very important problems to study.The thesis introduces ADR into construction industry. And from the angle of cost engineering consultation company, the feasibility of developing ADR business and access to the routing is analyzed.In this thesis, comparative study method, benchmarking management and SWOT analysis tool are used, and the key problems are solved from the aspects as follows:Firstly, based on systematically analyses of dispute resolutions in construction industry at home and abroad, ADR is introduced, and the advanced nature and the essence of the efficiency of ADR is analyzed with the Principal-Agent theory and Transaction Cost Theory. In addition, the key success factors are studied. All of these make theory introduction for ADR mechanism.Secondly, taking Hong Kong’s Davis Langdon and Seah and Levett and Belly as practical benchmark, two key conditions are summarized for cost engineering consultation companies to develop ADR business: the laws on macro-economic policy guidance and the micro-level for employees in improving the quality; SWOT is used to analyze external environment and internal environment of the cost engineering consultation company for developing ADR business. Through comparing with key terms, the possibility of cost engineering consultation company is demonstrated to develop ADR business.Thirdly, on the basis of the study on ADR at home and abroad, three models for ADR mechanism in China are summarized: the Court-annexed Model, the Contract Text Model and Loose Model. Through the identity and quality analysis of the three modles, it shows that the cost engineers can participate in ADR business as interceder, DAB or DBR member. Then, advices are put forward to establish ADR mechanisms from the angle of policy support of the government, personnel and organizations reform and so on.Finally, the ADR process for cost engineering consultations company to develop is discussed with a case.更多还原
