【摘要】 社会保障是工业社会的产物,是市场经济发展的产物。社会保障法律是各国法律体系中的一个重要组成部分。我国的社会保障法律制度在党和政府的关心和重视下得到了巨大的发展,颁布了《中华人民共和国劳动保险条例》、《中华人民共和国女工保护条例》等一系列的规章制度。改革开放以来,我国的社会保障事业得到了快速的发展,制定了养老保险等一批社会保障法律制度,但从整体来看,社会保障立法的规模不大,规格不高,法制化程度低,国家尚不能对社会保障面临的复杂问题提供充分有效的法律依据,更远远不能满足市场经济和社会保障事业发展的需求。因此,本文对构建我国的社会保障法律制度的重要性和可行性进行了充分的论证,并且对如何构建社会保障法律制度提供了一些建议。第一章阐述了文章的基本问题,包括研究背景、问题的提出、研究现状、研究目的、方法、意义、研究创新及不足以及今后研究方向。第二章旨在全面阐述构建我国社会保障法律制度的理论基础和现实必要性,从而提高人们对社会保障法律制度的认识,促使各项社会保障政策顺利实施和运行。第三章介绍了社会保障法律制度的由来以及我国社会保障法律制度的发展,对我国社会保障法律制度的历史和作用进行了全面总结与概括。第四章分析了我国社会保障法律制度运行的现状,论述了我国社会保障制度存在的种种缺陷和需要改进的地方。第五章探究了外国社会保障法律制度的发展和特点以及我国社会保障法律制度发展与改革。主要分析了国外主要发达国家的社会保障法律制度的现状及其特点和对我国社会保障法律制度建设的启示。第六章探讨社会保障法的体系结构,旨在从宏观上指导社会保障立法,使社会保障法具有最佳结构和效能,同时全面提出解决当前我国社会保障法律制度问题的对策。更多还原

【Abstract】 Social security is a product of industrial society; it is the product of economic development. Social Security is a national law in the legal system an important component. China’s legal systems of social security in the party and the government under the care and attention has been tremendous progress, promulgated the "People’s Republic of China labor insurance regulations," "Regulations on Protection of the People’s Republic of women" and a series of rules and regulations. Since reform and opening up, China’s social security has been the cause of the rapid development and formulated a number of old-age insurance and other legal systems of social security, but overall, the social security legislation of the size, specifications are not high, low levels of the legal system, States are not yet able to social security the complex problems facing the provision of adequate and effective legal basis, fall far short of market economy and the development of the cause of the social security needs. Therefore, this paper on the Construction of China’s legal systems of social security of the importance and feasibility of a full feasibility studies, and on how to build a social security system provides a legal point proposal.This article first chapter of the articles on the basic issues, including research background, the question raised on the status quo, research purposes, methods, meaning, innovation, research and lack of direction for future research.Chapter II seeks to comprehensively expounded China’s construction of legal systems of social security based on the theoretical and practical necessity, to raise awareness of the social security system of law, social security policies to the smooth implementation and operation.The third chapter on the legal systems of social security and the origins of China’s legal systems of social security development in China’s social security system of legal history and role of a comprehensive summary and summaryChapter 4 of China’s social security system of running the legal status quo, discussed China’s social security system is defective and needs of the various areas of improvement.Chapter V explores the foreign legal systems of social security and the development and characteristics of China’s social security system development and legal reform.
