【副题名】以诉讼要件审查为中心

【摘要】 中国社会儒家思想长期居于支配地位,以重义轻利为价值取向。民事诉讼制度只能依附于刑事诉讼制度,从而造成民事起诉制度的缺失。1982年我国颁行了民事诉讼法(试行),1991年修改后正式实施,但由于长期的重实体轻程序的传统的影响,法律条文过于简略,在实践中随意性很大。现行民事诉讼法对当事人起诉和法院立案审查制度的相关规定,是就起诉要件与诉讼要件所作出的一并规定,导致了当事人起诉权与法院审判权的错位以及在程序上的非对称性。在此情形下,有必要就我国的民事案件立案审查制度进行重构,将审查的内容限定为起诉要件的范畴。当事人起诉成立后,案件即系属于法院,诉讼要件是否存在,必须经法庭开庭审理并经双方当事人言词辩论后才能确定。同时要对当事人的起诉权的行使进行规制,以防止当事人起诉权滥用。更多还原

【Abstract】 In the traditional socialty of China, the Confucianism kept its ascendancy for very long time, whose value tropism lied in stressing justice and despising profit. the civil action system leeched on to criminal action system, which caused the lack of civil pleading system. our country promulgated the code of civil procedural law (trial operation) in 1982, and carried into execution formally from 1991after being amended. For the influence of long time tradition of stressing substance and neglecting procedure.The rules are very simple, and are in a greatly optional application in practice.The provisions about the system of parties’pleading and court’s examination in the present civil procedure law, are to regulate the document of pleading and action at same time, which leads to the wrong place between the right of parties’pleading and the one of court’s examination, and the non-symmetry in the procedure, Under the situation like this, it is necessary to reconstruct the registering examination system for civil case, and we need confirm that the contents being checked should belong to the pleading document. After the case is successful to be accepted, it belongs to the court. Of course, the decision is made by the court’s trial after the wordage argument with the parties. the limitation to party’s pleading rights is necessary, to prevent the abuse of their pleading right.更多还原
