【摘要】 弱势群体问题是当今社会普遍存在的现象。随着我国社会主义市场经济的发展和社会结构的急剧转型，弱势群体问题更为突出。弱势群体是在改革开放过程中产生的，他们所面临的问题，必须通过深化改革开放来解决。保障弱势群体人权，使他们共享改革开放的成果，已经成为保持我国社会持续稳定发展和建设社会主义和谐社会的重要内容。研究弱势群体人权保障制度，探讨中国弱势群体的法律保护问题，具有重要的理论价值和现实意义。本文从法学研究的角度，对我国弱势群体人权保障的有关概念和相关理论进行分析，在对国外相关制度考察的基础上，从中找出一些完善我国有关制度的借鉴，通过分析我国弱势群体人权保障制度的现状，提出从立法、行政执法和司法改革等方面来完善我国弱势群体人权保障制度的对策。本文由引言、正文、结语三大部分组成。引言部分简要介绍了本文的写作背景。正文分四部分对我国弱势群体人权保障制度进行了深入研究。第一部分是有关弱势群体人权保障的基本理论。本部分从不同的角度对弱势群体的概念进行了界定，分析了弱势群体的产生原因、构成和特征，阐述了弱势群体人权保障的概念和基本内容，从法理学、宪法学、行政法学、社会法学等方面论述了弱势群体人权保障的正当性与合理性。第二部分是对国外主要国家有关制度的借鉴。国外弱势群体人权保障制度的主要内容是社会保障制度。文章通过对美国、德国、瑞典等国相关制度的考察，认为立法是建立相关制度的重要手段，这对完善我国弱势群体人权保障制度是一个很好的借鉴。第三部分对我国弱势群体人保障制度现状进行了分析。本部分主要阐述了我国弱势群体人权保障制度的立法现状和实施中存在的问题，从多个方面分析了产生问题的原因。第四部分是关于完善我国弱势群体人权保障制度的对策。本部分针对我国弱势群体人权保障制度实施中存在的问题，提出完善我国弱势群体人权保障制度，必须以宪法为依据，清理不合理的法规，以完善社会保障制度、劳动保障制度为起点，以依法行政为支撑，以司法救济为后盾，构建全面的弱势群体保护网。结语部分指出本文的研究对完善我国弱势群体人权保障制度的推动作用。本文在写作过程中运用了历史研究方法，以期使历史问题在现实中得到解决，同时采用中西法律比较和价值分析方法，既放眼世界，又立足国情，使本文具有一定的理论高度和现实意义。总之，在弱势群体人权问题已被社会普遍关注、而相关研究略显不足之际，本文以完善我国弱势群体人权保障制度为切入点，探讨如何在构建社会主义和谐社会的时代背景下解决弱势群体问题，以促进我们社会更加和谐。更多还原

【Abstract】 Vulnerable groups in society today is a widespread phenomenon. With China’s socialist market economic development and social structure of the rapid transformation, vulnerable groups problems emerged. How to improve the protection of human rights of vulnerable groups, to enable them to share the fruits of reform and opening up, as social sustainable development and construction and the building of a harmonious socialist society an important element.From the perspective of jurisprudence, on the protection of human rights of vulnerable groups in the concepts and theories related to the analysis, related to foreign inspection system on the basis to find some improving the system of reference, By analyzing the human rights of vulnerable groups in China to protect the status quo, from the proposed legislation, administrative law enforcement and judicial reform and so on to improve the human rights of vulnerable groups in our country protection system response.The paper is made up of the preface, the text and the conclusion. The preface briefly introduces the background of this paper. The text is composed of four parts. The first part is mainly about the basic theories about the protection of human rights of vulnerable groups; the definition of vulnerable groups from different perspective, the cause, composition and characteristics of vulnerable groups; From jurisprudence, constitution, administrative law, social law, and so on, to protect the human rights of vulnerable groups with some theoretical basis. Its legal theory based on the theory of social relations of equality, justice, sustainable development, law is through rational distribution of public power and the rights of the individual has reached the protection of vulnerable groups.The second part of the text is to study foreign human rights protection system. The vulnerable groups of human rights protection system of western countries mainly is the social security system. We selected the United States, Germany, Sweden, by looking into the establishment of a social security system development process. This is crucial to our national that by legislative to improve the protection of human rights of vulnerable groups as well as a good system of reference. The third part of the main content of the text from the system of protection of human rights legal achievements and shortcomings during the implementation process of the legal system, analysis the cause of the implementation process of the legal system shortcoming , Chinese in the protection of human rights system has made significant progress. However, as feudal thought and the level of development and productivity constraints, human rights of vulnerable groups in our country the system is still inadequate in many respects to be perfected.
