【摘要】 随着现代科技的不断发展,人类正跨入以计算机和网络技术为基础、以多媒体技术为特征的网络时代。信息网络技术的出现为信息的收集、传播和管理等提供了得天独厚的物质条件,改变了人们传统的生活方式,扩展了人们交往的范围和空间。然而,人类在享受它带来的众多方便的同时,也使得个人隐私遭到前所未有的威胁。网络技术的运用使得隐私的领域从传统的物理生存空间扩展到网络世界。隐私的外延也空前扩大了,出现了新的表现形式——网络隐私。由于网络隐私不同于传统的隐私,在互联网的背景下,凭借网络本身的特点,侵犯网络隐私权的事件层出不穷,受侵害的程度也有严重化的趋势。因此,如何保护网络隐私权就成为了当前亟待解决的问题。本文从分析网络隐私受到侵犯的原因入手,着重从三个方面进行了阐述。从网络技术本身来讲,网络由于其开放性、虚拟性、数字化、匿名性等特点为在更大的范围,更严重的程度侵犯隐私提供了技术上的可能。然而技术的运用是掌握在人的手中的,对其“善”的或“恶”的运用取决于人本身,本文认为人在道德层面上的失范是造成网络隐私权受到侵害的根源。此外,外部环境如法律、伦理、规范、监督、惩罚等各种社会组织体系还不完善,也是导致网络隐私权受到侵犯的原因。文章的最后,就如何防范和保护网络隐私提出了基本的思路和建议,认为我国的网络隐私权保护要走综合发展的道路。更多还原

【Abstract】 With development of modern science and technology,human is entering the Internet age which based on computer and network technology and characterized by multimedia technology.The advent of information network technology provides information collection, dissemination and management with exceptional material conditions,and it changes the traditional way of life of people and also expands the communication space between them.While people enjoys the conveniences brings by the information technology, their personal privacy are encountered unprecedented threat. The application of Internet technology expands the area of privacy from the traditional physical living space to the Internet world.The extension of privacy also experiences unprecedented expansion and shows a new form of expression—Internet privacy.Because of the network privacy is different from the traditional privacy,people use the characteristics of the network to invade privacy and make network privacy violations occur more frequently than before and show a more and more serious trend in the internet background.Therefore,how to protect network privacy is increasingly becoming a pressing issue today.This article is start by analyse the reason of the invasion of network privacy, and put emphasis on three aspects. Refered to network technique itself , it provides technical possibility with serious invasion of network based on its characteristic of openness, virtual, digital and anonymous. However, the use of technology command by human and its“good”or“evil”aspects depends on people how to use it. This article hold the idea that network privacy invasion result in the loss of people′s moral level.In addition, the external environment such as legal, ethical, normative, supervision, punishment and other social organization system is not perfect is one of reasons which cause network privacy invasion as well.Finally,the article shows the basic ideas and suggestions on how to prevent and protect network privacy and considers that China’s network privacy protection should take a comprehensive development path .更多还原
