【摘要】 宪政主义是人类智慧的产物,是人类政治文明和法治文明的结晶。新宪政论的提出更彰显了宪政主义的持久的吸引力。新宪政论不是一个新的宪政思想学派,也没有建立一套完整的理论体系,它还只是一种思潮,一种探索。古典宪政论是新宪政论的理论渊源,在现代西方政治学说和宪政理论中,宪政理论的核心问题是“有限政府”,即限制政府权力,保护公民权利。它解决了为什么和怎么样限制政府权力保护公民权利的问题。新宪政论也是建立在这一传统的基础之上的,它是对古典宪政论的复兴与重建。古典宪政论在当代遭遇了学科上的困境和时势的挑战。新宪政论的提出就是为了复兴这一传统。然而,当代世界的急剧变化也要求新宪政论突破古典宪政论。新宪政论在设计制度以改善政治制度原则的指导下进行构建,提出了“一般宪政论”、“多元政体论”等一系列新的宪政思想。这些新的宪政思想不仅仅关注限制国家权力,也关注对社会权力的限制,切实保护新时代下个人的权利不受各种权力的侵犯;不仅仅关注“有限政府”,也关注“有为政府”以及公民美德,从而不仅通过限制政府权力来保障人权,也通过良好地运行政府和公民的参与来保障人权。此外,新宪政论明确表明了它被称之为“新”“宪政论”的原因,即表明了它对古典宪政论的继承与发展之处。新宪政论为我们提供了一个新的研究视角给我们带来了启迪,对中国的宪政理论研究和建设实践都有一定的借鉴意义,它要求我们要同时关注新旧宪政论所提出的问题,协调处理两者的关系。更多还原

【Abstract】 Constitutionalism is the fruit that human intelligence bears, and the crystallization of political and rule-of-law civilization. Proposing of the new constitutionalism has revealed lasting attraction of constitutionalism. The new constitutionalism is not a new constitutional school of thought, also has not established a set of integrated system info, and it also is only one kind of ideological trend, one kind of exploration. The classical constitutionalism is theoretical source of the new constitutionalism, according to modern political theories in the west countries, the essence of constitutionalism is“the limited government”, namely is to limit the powers of government to protect the rights of citizens. What has it solved is why and how limits the powers of the government to protect the rights of citizens. The new constitutionalism also established on foundation of this tradition, and it is the renaissance and the reconstruction of the classical constitutionalism. The classical constitutionalism has encountered trouble in the discipline and challenge of the current situation. Proposing of the new constitutionalism is to revive this tradition. However, rapid changes of the contemporary world also request the new constitutionalism to break through to the classical constitutionalism. The new constitutionalism proposed a series of new constitutional thoughts such as "the common constitutionalism" and so on under the instruction of the principle which designs systems to improve political systems. These new constitutional thoughts not only pay attention to limiting powers of the state, but also pay attention to limiting the social powers in order to practically protect individual rights under the new times not to be infringed, not only pay attention to "the limited government", but also pay attention to "the promising government" as well as the civil virtue, thus not only safeguards the human rights through limiting powers of government, but also safeguards the human rights through running the government well and citizen’s participation. In addition, the new constitutionalism has explicitly indicated why it was called " new" "constitutionalism", namely has indicated inheritance and development to the classical constitutionalism. New constitutionalism, which provides us with a new perspective of inspirations, is of theoretical and practical reference to the construction of Chinese constitutional policy, which requests us to simultaneously pay attention to the questions that the new and old constitutionalism proposed and deals harmoniously with the relations of the both.更多还原
