【摘要】 妇女占世界人口的一半,是人类自身的创造者和生产者,妇女人权则是普遍性人权中不可分割的组成部分,她们的法律地位如何,体现了一个国家的文明与进步程度,但是由于历史和现实的种种原因,妇女受到歧视是普遍的现象,她们常常在法律上和事实上都受到不平等待遇。在中国,建国以来我国政府非常重视妇女人权的法律保护,并取得了巨大的成就,成为世界保护妇女人权的楷模国家之一。改革开放以后,中国真正意义开启了自己的现代化的历史进程,而妇女人权的状况不仅对于妇女本身来说具有重要的意义,而且对于整个中国现代化来说都是一个重要的衡量尺度之一,同时妇女人权的实现又会为现代化的注入强大的动力,可以说现代化为妇女人权的彰显带来了前所未有的契机,中国的妇女人权将会在以前的基础上进一步发展。同时,现代化对妇女人权也带来了许多负面的影响,改革开放以来许多业已解决的问题死灰复燃,同时随着社会的发展,一些新问题、新情况层出不穷,严重威胁着妇女人权的实现,而关于这方面的研究和对策比较滞厚。现阶段关于妇女人权学术研究主要集中在1995年中国世界妇女大会前后,这一时期中国学术界掀起了研究妇女人权的热潮,不同学者著书立说,从人权的角度来论述如何保护妇女权利的实现,但是近十年妇女人权研究处于低谷期。到2004年随着国家尊重和保护人权写入宪法,学术界又掀起了研究妇女人权的高潮,但是这一时期妇女人权研究的往往只侧重一个方面来探讨妇女人权的保护问题,缺乏从宏观的层面上研究妇女人权的得失。本文以中国现代化为大历史背景,通过实证分析和比较分析,致力于真实客观的展现改革开放将近30年里中国妇女人权的真实状况,并试图分析原因和提出相应的解决对策。本文共分为五部分:第一部分在分析借鉴中外学者对妇女人权概念的基础上,提出自己对妇女人权概念的看法;文章的第二部分主要论述现代化对中国妇女人权的发展产生的积极影响,笔者在综合国内外关于现代化概念的界定,然后在此基础上分析现代化对妇女人权的发展带来了积极的影响;本文的第三部分与第二部分相对比,利用比较分析和实证分析,讨论改革开放以后中国妇女人权在现代化的进程中出现的问题,在真实的数据面前,笔者认为中国妇女人权很多方面在现代化的进程中确实出现了缺失的现象;本文的第四部分分析妇女人权缺失的原因,笔者认为在中国现代化进程中妇女人权的缺失是各种原因综合作用的结果;本文最后一部分针对妇女人权出现的问题,提出相应的对策,以期能够消除对妇女的歧视,更好的保障妇女人权,促进妇女人权与中国现代化大业的同步发展。更多还原

【Abstract】 The women share the half of the world population, and is creator of mankind , and the women’s human rights is a very important part of human rights . their law position is a civilization of nation degree.however, because of various reason of the history and reality, the discriminate of women is a very widespread phenomenon, they usually on the law with all be subjected to inequality treatment in fact.In china, our country government values the protection of women’s human rights very much, meantimes obtain a huge achievement , China become a model nation of protect women’s human rights in the world.The reform hereafter, the Chinese starts its history progress of the modernization, but the condition of women’s human rights is not only the importance for the women, but also is the whole inside country modernization important measures .the realization of women’s human rights is modern again in the meantime of infusion strong motive, of course the modern changes into women’s human rights to show to bring a big development , women’s human rights of China will develop further in the top of the foundation of the past.But the modernization also brought much negative influence to women’s human rights, the reform brings many problem of the baffling women rights realization that resolve already is cold ashes burn again, meantime,with the developments of the society, some new problems threatenning the realizations of women’s human rights seriously, but the researches concerning this aspects and the counterplan comparison is thick, even is the blind spot of the academic research.
