河北省征地补偿标准研究

【摘要】 征地补偿标准作为征地过程中的一个核心问题,直接关系到被征地农民的利益和征地工作的顺利实施。随着经济发展和城市化进程的加快,越来越多的农用地需要通过征用转变为建设用地。但是随着市场经济的建立和逐步完善,现有征地制度的不合理性日益显现,其中征地补偿问题尤其突出,集中表现为补偿过低,不能保证农民的生产和生活,引起农民的强烈不满,如不妥善解决,势必影响社会稳定与安全。为了解决现行征地补偿中存在的诸多弊端,全国各省份按照国土资源部的相关要求,先后开展了统一年产值标准和征地区片价的制订工作。征地补偿标准的制订关系到社会经济发展中一系列重大问题,如公平、利益冲突、社会稳定、生态问题等,具有深远的意义。本文以分析征地补偿理论和制度为切入点,首先对征地补偿标准的实质内涵和基本要求进行了论述;然后,对河北省新征地补偿标准的测算过程和测算结果进行了分析;最后,对河北省新征地补偿标准的测算结果进行实证分析,以验证其可操作性和科学性,为最终制订新征地补偿标准提供参考依据。本文研究表明:征地补偿标准的区域性分布特征较明显,并且新征地补偿标准相对现行征地补偿标准有较大幅度提高,测算结果基本满足测算要求,但是部分县级征地补偿标准测算结果偏低,应该根据当地实际进行修正。本文创新之处在于:运用GIS的数据管理和分析功能,实现了省域内统一年产值标准和征地区片价数据的整合;通过对征地补偿理论和国内外征地制度的分析,提出了检验新征地补偿标准测算结果合理性的思路和方法。更多还原

【Abstract】 Compensation standard of land requisition is a core question in the progress of land requisition, which directly refers to farmer’s benefit and land requisition works. Along with the economical development and urbanized advancement speeding up, more and more agriculture land needs to transform use for the construction through confiscation. Our country land requisition has begun in the planned economy time; it has made the significant contribution for the national economic construction and the social development since the founding of our country. But along with the market economy establishes and consummate gradually, the flaws of present expropriation system appear day by day, in which contradictory of compensation question is prominent. Excessively low compensation cannot be able to guarantee farmer’s production and the life, the land confiscation causes the peasant economy welfare to drop, compensation is obvious unreasonable. The present compensation standard generally is low in our country and there are many problems in the progress of providing compensation, this kind of phenomenon causes the society to be contradictory.In order to solve these malpractices, various provinces successively developed the making work of newly draft compensation according to the correlation request of national territory resources department. But the making work of compensation-standard has profound significance goes far into the future, which refers to a lot of eco-social problems, such as social justice, interest confliction, social stabilization, ecological problems due to land requisition.Firstly, this article analyzed the theory and system of draft compensation, and carried on elaboration the substantive connotation and the basic request about the compensation-standard. After that, it analyzed the process and the survey result on newly compensation standard of land requisition. Finally, to verification, we take the survey result of Hebei newly compensation standard as an example, which conclusions can provide the reference to drew up newly compensation standard.This article studies indicated that compensation standard of land requisition have the obvious regional distributed characteristic, and newly standard have a larger scale enhancement relatively to presently one. It was explained that the result basically satisfied the survey request, but partial county level actually should be carried on the revision according to the locality, which was somewhat low to the survey result. This article innovates place has two points. One is realized to unify the data of expropriation land price and standard of unified annual production in the province territory, by using GIS data-management and analysis function. Two, through analyzing the theory and system of land requisition, the rational examination mentality and the method was proposed, which was about the survey result of newly compensates.更多还原
