论德沃金的权利正义思想
On Dworkin’s Theory of Justice as Respect for Rights

【摘要】 罗纳德·德沃金(Ronald·Dworkin)是当代美国最著名,最活跃的法理学家之一。他生于1931年。1957年毕业于哈佛大学法学院,毕业后进入美国最高法院任法官汉德(Learned·Hand)的办事员,之后当过律师。1962年开始在耶鲁大学、纽约大学、康奈尔大学任教。1969年他应邀担任英国牛津大学法理学教授,现任英国牛津大学和美国纽约大学法学教授。他的代表作有《认真对待权利》、《法律帝国》、《至上的美德》、《自由的法》等。本篇文章着重论述德沃金先生的权利正义思想。全文分为五个部分,第一部分阐述德沃金权利正义思想产生的历史背景和理论前提;第二部分阐述德沃金权利思想;第三部分是文章的中心,着重阐述德沃金的平等理论,自由与平等的关系,平等理论的核心—平等地关注与尊重;第四部分从权利、自由与平等,权利与正义三个方面对德沃金与罗尔斯,诺齐克的权利正义思想进行比较;第五部分对德沃金的权利正义思想的几点思考。希望本文能对以后德沃金权利正义思想的研究有所启示。
【Abstract】 Ronald Dworkin is one of the most famous and influential jurists of modern America.Dworkin was born in 1931, and graduated from the Law School of Harvard university in1957,then he entered the Supreme court and became the judge Learned Hand’s assistant and laterhe worked as a lawer, He had taught as a legal thinker in Yale university, New York universityand Cornell university since 1962, in 1969, he was invited to be the jurisprudence professor ofOxford university, and now he is the law professor of Oxford university and New York university.His wrote some important works such as Taking Rights Seriously, Law’s Empire, SovereignVirtue and Freedom’s Law: The Moral Reading of the American Constitution, etc..This thesis is focusing on Dworkin’s theory of justice as respect for fights, It mainlydiscusses Dworkin’s theory of justice as respect for fights and falls into five parts. Part onemainly presents the historical background and the theory prerequisites of Dworkin’s theory ofjustice as respect for fights. Part two discusses his thought of fights theory. Part three is the mainpart of this thesis.It mainly discusses Dworkin’s theory of equality which consists of two basicprinciples of theory of equality, the relation between liberty and equality, and the core of theoryof equality-treats and respect for equality. Part four mainly discusses the difference ofDworkin’s theory of justice as respect for rights with John Rawls’s theory of justice as fairnessand Robert Noziek’s theory of justice as entitlement, the relation between liberty and equality.fights and justice. Part five gives some comments on Dworkin’s theory of justice as respect forrights and expects to do something to study Dworkin’s theory of justice as respect for rights.
